M <br />11. Utilities: Phase I will be unmanned on a day to day basis and <br />will not require any utility services. Phase II will be a <br />manned facility and will be connected to county water and <br />sewer services. This arrangement for future connection has <br />been approved by the Indian River County Department of Utility <br />Services. <br />12. Environmental Concerns: The project site consists of 8.13 <br />acres of native upland and 1.40 acres of wetlands, totalling <br />9.53 acres for the entire project area. Since the entire <br />project area is over 5 acres in size, the upland native <br />vegetation set aside requirement of LDR section 929.05 <br />applies. The applicant will be preserving at build -out 1.35 <br />acres or 16% of the 8.13 acres of native vegetation. This 16% <br />set aside area exceeds the county's 150 set aside area <br />requirement. Because the county cannot grant a conservation <br />easement to itself, no conservation easement can be required. <br />However, the required set aside area will be depicted on the <br />site planiand the approved site plan will be the controlling <br />document that will ensure preservation of the designated set <br />aside area. <br />The Phase I development will not impact any existing wetlands <br />on site; however, during Phase II construction approximately <br />1.21 acres of wetlands will be filled. The applicant can <br />proceed with Phase I construction without obtaining any <br />Jurisdictional agency or county wetland resource permit. <br />However, prior to site plan release for development of Phase <br />II, the applicant will need to obtain all required <br />Jurisdictional agency and wetlands resource permits for the <br />filling of the wetlands. The applicant has already applied <br />for these permits and is proposing to satisfy jurisdictional <br />agency and county mitigation requirements by performing off- <br />site mitigation work at the .Environmental Learning Center <br />site. <br />13. Dedications & Improvements: Both 77th Street and 58th Avenue <br />are listed on the County's Thoroughfare Plan. Additional <br />right-of-way will be required from this site for 77th Street <br />only, since additional right-of-way for 58th Avenue will come <br />from Hobart Park on the east side of 58th Avenue. <br />The Thoroughfare Plan lists 77th Street as a collector- roadway <br />which requires 80' of right-of-way. Since it is the County <br />Attorney's opinion that the county cannot dedicate property to <br />itself, the Utilities Department has agreed with the Public <br />Works Department to set aside 50' north of the existing 77th <br />Street roadway for additional 77th Street right-of-way. It is <br />the County Engineer's opinion that this additional area will <br />be sufficient to make the thoroughfare plan improvements to <br />77th Street. Thus, the proposed site plan accommodates right - <br />Of -wawwidths called -for in the Thoroughfare Plan and the <br />LDRs <br />Sidewalks are required improvements along the site's 77th <br />Street and 58th Avenue frontages. Required sidewalk <br />improvements may either be constructed in conjunction with a <br />project or be bonded-out/guaranteed for future construction. <br />The Department of Utility Services has committed in writing to <br />make provisions for a sidewalk along the project's 58th Avenue <br />frontage. The public works department has guaranteed the <br />construction of the required 77th Street sidewalk -improvements <br />and will provide said improvements during future 77th Street <br />roadway construction.
