O'Brien - Assistant County Attorney4 `� <br />DATE: February 2, 1993 <br />SUBJECT: PROPOSED ORDINANCE ENTITLED: <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA <br />AMENDING SECTION 100.089 INDIAN RIVER COUNTY <br />CODE TO MAKE THE GENERAL PENALTY PROVISIONS <br />APPLICABLE TO ORDINANCES PRIOR TO <br />CODIFICATION. <br />A public hearing date of March 9, 1993 is suggested for the subject <br />ordinance. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously scheduled <br />a public hearing March 9, 1993 to consider an <br />ordinance amending Section 100.05 of the Code to <br />make the general penalty provisions applicable to <br />ordinances prior to codification. <br />H. Subordination_ of County Lien - Impact Fee Extension Agreement <br />The Board reviewed memo from Lea R. Keller, CLA, County Attorney's Office <br />DATE: January 27, 1993 <br />RE: SUBORDINATION OF COUNTY LIEN <br />IMPACT FEE EXTENSION AGREEMENT <br />The County has an outstanding impact fee extension agreement that <br />created a lien on a certain piece of property which is owned by John L. <br />Hickey. Mr. Hickey, the property owner, is refinancing his mortgage, <br />and the mortgagee has requested the County consent to it being the <br />first lien holder on the property. Since, in this case, the County lien <br />Is not superior to the mortgage, this - request is agreeable to the <br />Department of Utility Services. <br />REQUESTED ACTION: Request the Board consent to the County <br />Administrator's signing the attached Subordination on behalf of the <br />County. <br />11 <br />BOOK <br />FE91993 <br />
