L - 6 19 9 3 BOOK <br />Conceptual Approval Agreement <br />89 PnUF 992 -7 <br />Since the May 10th FCT hearing, FCT staff have visited* the Wabasso <br />Scrub site with county staff to verify site conditions as <br />represented in the project application. In accordance with State <br />procedures, the next step is f or the FCT Governing Body and the <br />County Commission to execute a "Conceptual Approval Agreement". <br />FCT staff have transmitted the attached draft Conceptual Approval <br />Agreement to county staff relating to the subject property. This <br />Agreement will be considered by the FCT Governing Board at its next <br />scheduled meeting on July 8, 1993. <br />Although execution of the agreement by the County is not required <br />prior to the July 8, 1993 FCT Governing Board meeting, it is <br />important that the County review the draft agreement beforehand for <br />general concurrence. For this reason, the draft agreement is <br />presented herein for the Board's consideration. <br />ALTERNATIVES & ANALYSIS <br />The draft agreement consists largely of standard language and <br />conditions pursuant to Rule 9K-4, Florida Administrative Code, <br />which sets forth Florida Communities Trust program procedures. <br />The agreement consists of seven main sections, as follows <br />(paraphrased): <br />General Conditions <br />Requirements Prior to Initiation Of Negotiations <br />County Obligations Relating to Project Plan Approval <br />IV. Project Site Title Conditions <br />V. Obligations as a Condition of Project Funding <br />VI. Obligations Relating to Use of Bond Proceeds <br />VII. Site Specific Management Plan Conditions <br />The General Conditions section of the agreement contains standard <br />language pertaining to timing and coordination of steps between <br />the County and the FCT. <br />Requirements Prior to Initiation of Negotiations outlines a number <br />of steps and time frames including the requirement that the County <br />enter into a multi-party agreement with FCT prior to August 31, <br />1993, if the County chooses to conduct negotiation activities. <br />Also, the County is required to provide a resolution to FCT by <br />October 31, 1993, with information confirming such things as the <br />property owner being a willing seller, and the County's ability to <br />provide the local match. <br />County Obligations as a Condition of Project Plan Approva . I outlines <br />County documents required prior to FCT disbursement of State funds, <br />including a statement of total project costs, a signed agreement <br />for acquisition, and a management plan consistent with the criteria <br />and conditions within the Conceptual Approval Agreement. <br />Title Conditions relates to State requirements regarding transfer <br />of title procedures. <br />Obligations.as a Condition of Project Funding ensures that any use <br />of the property once acquired will be consistent with the adopted <br />management plan, or, if changes are proposed, that FCT approval is <br />first obtained. <br />Obligations Relating to the Use of Bond Proceeds requires the <br />County to notify FCT if any use of the property is proposed that <br />may af f ect State bond proceeds used in acquiring the property; with <br />respect to legal and tax consequences. <br />26 <br />
