M M <br />preservation areas will need to be provided on a phase by <br />phase basis, with each phase meeting or exceeding the <br />project's cumulative preservation requirements. The <br />preservation areas will be dedicated as conservation <br />easements on the project's final plats. <br />*Turtle Protection: Since the project fronts on the <br />Atlantic Ocean, the project is subject to the sea turtle <br />protection requirements of section 932.09, regarding <br />illumination of the beach. The applicant has agreed to <br />comply with the provisions of section 932.09, and the <br />submitted plans conceptually appear to meet the <br />requirements. If conceptual PD plan and special <br />exception approval are granted, subsequent preliminary,PD <br />plans will be reviewed in detail for compliance with the <br />criteria of section 932.09. <br />*Potential On -Site Wetlands: During the conceptual plan <br />review, the applicant identified a small area east of SR <br />A -1-A, as possible jurisdictional wetlands. Upon closer <br />inspection of the area by environmental planning staff, <br />it appeared as though the area was not a wetland. The <br />applicant has recently provided the staff with <br />documentation that the jurisdictional agencies concur <br />with environmental planning staff and have determined <br />that the areas identified are not wetlands (see <br />attachment 9). Therefore, no jurisdictional wetlands <br />occur on site and no wetlands alteration or fill permits <br />are -required for the project. <br />•Beach Mouse: While there have been some staff concerns <br />that -the federally endangered southeastern beach mouse <br />may be present on the site's oceanside portion, <br />preliminary trappings conducted by the applicant have not <br />trapped any beach mice on the site. Although no beach <br />mice have been trapped on site, the U.S. Fish and <br />Wildlife Service has indicated that a more extensive <br />survey would be required to verify that no endangered <br />mice exist on site. Rather than conduct an extensive <br />year-long survey, the applicant has agreed to assume that <br />beach mice may be on the site, and is continuing to <br />coordinate with the Florida Game and Freshwater Fish <br />Commission and the United States Fish and Wildlife <br />Service to prepare a habitat management plan that is <br />acceptable to both agencies and allows for the proposed <br />development of the site. The conceptual PD plan appears <br />to be consistent with the current habitat management plan <br />proposals, which primarily cover the project area located <br />seaward of the CCCL. Prior to issuance of a land <br />development permit for any construction on parcels A or <br />B (oceanside parcels), the applicant will need to obtain <br />Jurisdictional agency approval of the management plan or <br />obtain a letter from the agencies indicating that the <br />construction being permitted will not adversely affect <br />the habitat management plan area. <br />16. CONCURRENCY: The applicant has applied for a conditional <br />concurrency certificate which has been reviewed by staff and <br />will be issued prior to consideration by the Board of County <br />Commissioners. <br />17. OWNERSHIP OF UNITS: The applicant is proposing to market the <br />residential resort units as timeshare condominium units.
