5. A warranty and maintenance agreement and financial security <br />for the publicly dedicated improvements. <br />6. A consent and joinder to be executed by the Chairman of the <br />Board of County Commissioners to subordinate utility liens <br />presently in place on a portion of the subdivision. <br />ANALYSIS: <br />All required subdivision improvements have been completed by the <br />developer, with the exception of a sidewalk along the project's <br />16th Street frontage, and the developer has obtained a certificate <br />of completion certifying that all required improvements, except the <br />sidewalk, have been completed and are acceptable. The project <br />subdivision- improvements are privately dedicated, with the <br />exception of -a right -turn lane built in the 16th Street right-of- <br />way, the utility system (which has been properly warranted through <br />the County Department of Utility Services), and the to -be -built <br />16th Street sidewalk. The public works department has reviewed and <br />approved the engineer's certified cost estimate for the sidewalk <br />along 16th Street and the publically dedicated right turn lane. <br />The obligation for the sidewalk construction will be transferred <br />from the developer to the county through a transfer agreement and <br />financial security approved by the Public Works Director and the <br />County Attorney's Office. <br />The developer has executed a warranty maintenance agreement backed <br />by 25% of the cost of construction of the right -turn lane. The <br />Attorney's Office has reviewed and approved the sidewalk transfer <br />agreement and the Warranty and Maintenance Agreement. Therefore, <br />the developer has complied with all applicable requirements for <br />final plat approval. <br />Indian River County has a lien (for water and sewer) against a <br />portion of the property being platted as Rosewood Court <br />Subdivision. A consent and joinder has been prepared by the County <br />Attorney's Office for Board approval, so that our lien will be <br />subordinate to the dedication. The Director of the Department of <br />Utility Services has signed -off on the consent and joinder, the <br />Board will need to authorize the chairman to execute the consent <br />and joinder on the County's behalf. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant final <br />plat approval for Rosewood Court, accept the Warranty and <br />Maintenance Agreement and corresponding posted security, and <br />authorize the Chairman to execute the Consent and Joinder. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously granted <br />final plat approval for Rosewood Court, accepted the <br />Warranty and Maintenance Agreement, and authorized <br />the Chairman to execute the Consent and Joinder, as <br />recommended by staff. <br />COPY OF WARRANTY AND MAINTENANCE AGREEMENT ARE ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />5 <br />A <br />8 1994 BOOK <br />
