r- <br />MAR 22 1994 <br />Booz 91 FAUF 1039 <br />—7 <br />15. Environmental Issues: Walkways are depicted on the conceptual <br />plan and are to be located within wetland areas. These <br />walkways would connect to the parcel on the west side of <br />Indian River Boulevard by running the walkways underneath the <br />Indian River Boulevard bridge. Approval of running the <br />walkway under the bridge has not yet been granted and must be <br />further reviewed by Public Works and Risk Management. <br />The extent of the wetlands on the east and west sides of <br />Indian River Boulevard will need to be delineated and verified <br />by jurisdictional agencies (i.e., the Army Corps of Engineers <br />and St. Johns River Water Management District). Once these <br />areas are identified, a County Wetland Resource Permit will be <br />required, including the requirement of mitigation for any <br />proposed wetland filling. Mitigation credit may be given for <br />stormwater tract littoral zone areas. Environmental planning <br />staff has indicated that, conceptually, the plan is feasible, <br />subject to the approval of jurisdictional agencies.* <br />Environmental planning staff is aware of an Indian midden <br />along the project's shoreline, and has determined that <br />development of the project will present no impact upon the <br />archeological site. Therefore, the conceptual plan satisfies <br />the county's requirements relating to archeological resources. <br />16. Concurrency: The applicant has obtained a conditional <br />concurrency certificate for the proposed project. Therefore, <br />all applicable concurrency requirements related to conceptual <br />plan approval are satisfied. <br />RECOMMENDATION: <br />-Based on the above analysis, staff recommends that the Board of <br />County Commissioners grant P.D. special exception use and <br />conceptual plan approval with the following conditions: <br />1. That prior to .the issuance of a Certificate of Occupancy <br />(C.O.) for any portion of the project, all improvements <br />depicted within the Indian River Boulevard right-of-way and <br />east of the Boulevard right-of-way be included in Phase 1 of <br />the project and be installed. <br />2. That prior to issuance of a land development permit for the <br />project, the property owner shall document riparian rights <br />for access to and use of the 14th Street canal. <br />3. That prior to issuance of a land development permit, the <br />applicant shall obtain a County Wetland Resource Permit, <br />including the requirements - of mitigation for any wetland <br />filling on the project site. <br />4. That egress from the site onto Indian River Boulevard be <br />limited to "right -out" movements only. <br />5. That in return for a density bonus of 25 project units, the <br />project be restricted to a maximum of 180 residential units <br />and a minimum of 38 affordable housing rental units at project <br />build -out. In addition, the following conditions apply: <br />a. Prior to site plan release, the <br />the county a letter from a <br />verifying that the project is <br />federal housing program which <br />affordable housing requirements <br />in LDR section 911.14(4) and <br />34 <br />applicant shall submit to <br />state or federal agency <br />committed to a state or <br />satisfies the county's <br />for rental units as found <br />that a state or federal <br />
