Other than seasonal <br />sales and the sale of agricultural products from agriculturally <br />zoned property, roadside retail sales were generally prohibited by <br />code in most counties. <br />It is staff's position that current county regulations are <br />sufficiently permissive, maybe too much so. Even with existing <br />temporary use permit requirements, transient merchant sales have <br />certain safety and aesthetic constraints. Also, because of <br />negligible initial investment and marginal overhead costs, <br />transient merchants have financial advantage over other retail <br />stores for which site plan approval has been obtained. In fact, <br />the tradition of allowing county -grown resources to be sold along <br />the roadside is the only apparent justification for retaining the <br />allowance for the transient merchant uses already allowed. Staff <br />feels that the transient merchant sales allowance should not be <br />expanded. <br />Alternatives <br />The Board of County Commissioners has several alternatives in <br />addressing the matter at hand. These include: <br />1. Leaving county regulations as they are, and thereby continuing <br />to prohibit roadside sales of flowers in the county; <br />2. Modifying county regulations to allow for the addition of a <br />transient merchant classification for flower 'sales (only); <br />3. Modifying county regulations to allow for the sale of any <br />types of products as a transient merchant use; <br />4. Modifying county regulations to eliminate on-going transient <br />merchant operations, allowing only seasonal transient <br />merchants; or <br />5. Modifying county regulations to eliminate entirely the <br />allowance of new transient merchant sites in the county <br />(grandfathering -in or amortizing existing sites); or <br />Modifying county regulations to eliminate entirely the <br />zllowance of transient merchant use in the county. <br />'ATION: <br />.:ommends that the Board of County Commissioners .leave the <br />.s transient merchant regulations as they are, and thereby <br />ambit roadside flower sales in the unincorporated county. <br />Planning Director Stan Boling outlined the various roadside <br />vending regulations and advised that vending of flowers was not an <br />allowed transient merchant use under County regulations. He <br />recommended the regulations not be changed. <br />Stan Courtright stated that after 6 successful months of <br />roadside sales he was informed he had to discontinue doing <br />business. <br />18 <br />s � � <br />
