� � r <br />INDIAN RIVER COUNTY ZONING ORDINANCE <br />#90-16 OF 9/11/90 <br />COMMERCIAL DISTRICTS #911:10 <br />PURPOSE & INTENT: The commercial districts are <br />established to implement. the Indian River County <br />Comprehensive Plan policies for commercial development. <br />These districts are intended to permit the development <br />of commercial property, to provide a efficient use of <br />land and public intrastructure, promote the economic <br />well being of the county, protect the natural resources <br />and beauty of the county, and ensure commercial <br />development compatible with existing and proposed <br />development. <br />In order to achieve this purpose, these districts shall <br />regulate the size, scope, and location of commercial <br />uses and provide standards to ensure development <br />compatible with the built and natural environment. <br />The "CL" district is intended to provide areas for the <br />development of restricted commercial activities, and <br />intended to accommodate the convenience retail and <br />service needs of area residents, while minimizing the <br />impact on any nearby residential areas. <br />The word "minimizing" is crucial to the judicial intent <br />of the County Zoning Ordinance. The American College <br />Dictionary, 1966 edition clarifies the meaning. <br />"Minimizing (verb) to reduce to the smallest possible <br />amount or -degree. To represent at the lowest possible <br />estimate." A negative loss of.119.3% does not agree with <br />minimizing the impact on any nearby residential areas. <br />We hope that County officials, after reviewing all the <br />evidence, will reject for the third time the developer's <br />plan for a supermarket in The Moorings. <br />Mr. Salmon concluded his presentation by urging the Board to <br />deny the Halvorsen appeal. <br />Attorney Warren Dill reviewed the following material titled <br />Authority to Deny Site Plan Approval dated 7/12/94: <br />100 a00K 94W F'A E 874, <br />July 12, 1994 <br />L_ <br />
