ma 92 iv -qn 8 6 <br />July 12, 1994 - <br />AUTHORITY TO DENY SITE PLAN APPROVAL <br />Chapter 914. Site Plan Review and Approval Procedure <br />Section 914.02. Purpose and intent. <br />The purpose of this section is to establish uniform requirements and procedures for reviewing <br />applications for site plan approval. It is further the intent of this section to establish procedures and <br />standards to implement the goals and policies of the Indian River County Comprehensive plan, and to <br />ensure compliance with the intent, standards, and procedures of all applicable land development <br />regulations. <br />— Section 914.06... Procedures for Site Plan Review. <br />(6) Planning and zoning commission decision. The planning and zoning commission (Board of <br />County Commissioners) shall consider each site plan ... and shall base its decision on the use, <br />size and dimension regulations for the respective zoning district, the site review standards <br />*established herein and all other applicable land development regulations, and comprehensive <br />plan policies. The planning and zoning commission (Board of County Commissioners) may <br />impose conditions on-site plan approval which ensure compliance with all applicable land <br />development regulations and comprehensive plan policies. <br />Section 914.15. Review standards and requirements. <br />(1) Purpose and intent. The purpose of this section is to establish standards for reviewing site plans <br />in order to ensure compliance with applicable county regulations. <br />(2) Applicability. Site plans shall be reviewed pursuant to all applicable zoning district regulations <br />and regulations for specific land uses, as applicable. <br />(7) Use and maintenance of site and zoning standards. <br />(b) All zoning district criteria must be met, including but not limited to: <br />(10) Use(s). <br />(8) Other Critical Site Plan Project Requirements and Review Standards. ...Site plan applications shall <br />comply with all land development regulations ... <br />(2) Zoning, chapter 911; <br />STANDARDS NOT MET <br />The purpose of all zoning in the county is found in Section 911.01(2) Purpose and intent: <br />(2) Purpose and intent ... to secure safety from fire, panic and other dangers; ... to conserve <br />the value of buildings ... <br />REASONS TO DENY SITE PLAN <br />The letter from Sheriff Wheeler concerning the proposed development states in part that ... "It is <br />reasonable to believe from past experience that there will be an increase in vehicle accidents, shoplifting, car <br />burglaries and other types of crimes associated with retail and commercial businesses." <br />The appraisal from Armfield-Wagner states in part that ...
