3. This concept --a small enclave of village -type shops and <br />small grocery store --remained firm over the years, <br />although its construction did not take place. The <br />concept was re -iterated in the planning staff's <br />recommendations to the Board of Commissioners at its <br />meeting November 20, 1985 to consider, among other <br />things, the establishment of the boundaries for the ten <br />(10) acre commercial node located in the Moorings on A- <br />1 -A between Mooring Line Drive and Spyglass Lane which <br />was a part of establishing the Master Land Use Plan <br />(Enclosure #2). <br />"Existing Land Use Pattern <br />The area surrounding the node area is predominantly <br />residential. There are single-family residences and <br />condominiums located to the east, north, and west <br />of the node's general location. Vacant land is <br />located to the south of the node. <br />Within the node's proposed boundary, there is a <br />sales office for The Moorings Development <br />Corporation location on the corner of Windward Way <br />and A -1-A on Lot 56. There is a Savings and Loan <br />institution currently being constructed on the <br />corner of Windward Way and A -1-A on Lot 57. The <br />Savings and Loan is the first phase of 'The <br />Trellises" commercial center being developed by The <br />Moorings Development Corporation. The proposed site <br />plan includes a small grocery and drug store, <br />specialty retail shops, and offices. This <br />commercial center should adequately serve the <br />residents in the south beach area." <br />Note again the concept "small grocery store," <br />persisting 17 years after the original zoning was <br />granted. <br />4. And now after 25 years a developer comes along and wants <br />to place a large supermarket on the site, claiming it to <br />be allowable under the zoning designation. <br />5. We believe a law suit is not required to determine that <br />a supermarket and grocery store are not the same. Common <br />horse sense tells us they definitely are not the same. <br />if you asked 100 people at random, probably 98 would say <br />they were not the same. <br />s6. We believe in property rights. In this case, we believe <br />the people of the Moorings have more property rights, <br />particularly those adjacent to the area in. question, than <br />does a developer who doesn't even own the land. If under <br />the prevailing circumstances he has some semblance of <br />"vested interest," it certainly is small compared to the <br />investment and property rights of the adjacent <br />residential properties. <br />110 <br />July 12, 1994 <br />Boob 92 PACE 88 <br />
