BOOK 92 PAGUE 981 <br />10. Concurrency: The developer has obtained a conditional <br />concurrency certificate for the 55 units. Thus, concurrency <br />requirements for conceptual and preliminary plan approval are <br />satisfied. <br />11. Environmental Issues: The 48.88 acre addition consists <br />largely of native upland habitat, typified by xeric, sandridge <br />type vegetation. Since the site is over 5 acres in size, the <br />native upland set-aside requirements of LDR section 929.05 <br />apply. In addition, the site may include habitat for <br />federally listed endangered species such as the Scrub Jay and <br />Gopher Tortoise. <br />The applicant is working with county staff and representatives <br />of the US Fish and Wildlife Service to satisfy the county's <br />native upland set-aside requirements and the endangered <br />species concerns with one preservation area plan. Native <br />upland set-aside requirements will need to be addressed by <br />conservation easements established throughout the overall <br />project area. Endangered species concerns will need to be <br />addressed by the developer by providing county staff with a <br />letter from the U.S. Fish and Wildlife Service stating that <br />U.S. Fish and Wildlife Service has no objection_ to the <br />issuance of a land clearing and tree removal permit for this <br />project. Such a letter will need to be submitted to county <br />staff prior to issuance of land clearing and tree removal <br />permits. <br />12. Buffers: A 25' wide Type "D" buffer is required along the <br />project addition's east and north perimeters. A 25' wide Type <br />"C" buffer is required along the project addition's south <br />perimeter. The golf improvements will be located along the <br />perimeters of this project, and will serve to meet the 25' <br />setback. Preserved vegetation will satisfy -the buffering <br />requirement. <br />13. That prior to issuance of a Certificate of Occupancy (C.O.) <br />and use of the golf course, the applicant shall obtain a <br />determination from the Public Works Director regarding whether <br />or not the subject segments of 1st Avenue S.E. are required to <br />be brought up to the county's two-way local road standard. If <br />the Public Works Director determines that the subject segments <br />of 1st Avenue S.E. must be brought -up to the county's two-way <br />standards, then prior to the issuance of a Certificate of <br />Occupancy (C.O.),the developer shall escrow with the county <br />the necessary funds (as determined by the Public Works <br />Director) for the future paving of 1st Avenue S.E. for two-way <br />operation. <br />July 19, 1994 <br />86 <br />M M <br />
