1.05 <br />d. Coordination information, including a list of changes or modifications <br />needed to other parts of the Work and to construction performed by the <br />Owner and separate Contractors that will become necessary to <br />accommodate the proposed substitution. <br />4. Certification by the Contractor or manufacturer that the substitution proposed is <br />equal -to or better in every respect to that required by the Contract Documents, <br />and that. it will perform' equal or superior to product specified in the application <br />.indicated. The Contractor waives any right to additional payment or time, which <br />may subsequently become necessary because of the failure of the substitution to <br />perform adequately. <br />5. Engineer's Action: The .Engineer may request additional information or <br />documentation necessary for evaluation of the request. The Engineer. will notify <br />the ' Contractors of acceptance of the proposed substitution by means of an <br />addendum to the bid documents. If the proposed substitute is accepted through <br />an addendum use the product specified by name. <br />B. Engineer's Substitution Approval during bidding and subsequent addendums does not <br />void the Contractor's responsibility to submit the required shop drawings -and comply <br />with the other contract documents and requirements. <br />SUBWEITTALS — AFTER AWARD OF CONTRACT <br />A. After award, any requests for approval of equivalent items shall be submitted in writing <br />to the Engineer for review within seven (7) calendar days after Notice to Proceed. <br />B. Submit each request in writing for substitution for consideration in accordance with <br />procedures required below. <br />C. Requests for approval of equivalent items shall be accompanied by information sufficient <br />for the Engineer to make a determination as to the equivalency of a product. The <br />determination of the Engineer of the equivalency of a product shall be final. The <br />Engineer reserves the right to request. information or documentation for evaluation <br />including but not limited to the following:. <br />1. Statement indicating why specified product cannot be provided. <br />2. Coordination of information, including a list of modifications needed to other <br />parts of the work that will be necessary to accommodate proposed substitution. <br />3. Product data including drawings, descriptions, and fabrication/installation <br />procedures. <br />4. Samples where applicable. <br />5. Material test reports from a qualified testing agency indicating the interpreting <br />test results for compliance with requirements. <br />6. Contractor's certification that proposed substitution complies with requirements <br />in the contract documents and is appropriate for applications indicated. <br />7. Contractor's waiver of rights, to additional payment or time that may <br />subsequently become necessary because of failure of proposed substitution to <br />produce indicated results. <br />8.
