f. At any time during the construction and completion of work covered by <br />these Specifications, if the conduct of any workman of the various crafts <br />be determined unsuitable or a nuisance to the Owner or Engineer, or if the <br />workman be considered incompetent or detrimental to the work, the Con- <br />tractor shall order such party removed immediately from the grounds with <br />the person not returning at any time during the course of work on the pro- <br />ject. <br />g. During the performance of any work by the Contractor or subcontractors, <br />the Contractor shall provide for the entire length of the project a full time <br />onsite superintendent/representative meeting the following requirements: <br />i. For the purpose of these Specifications the designation "superin- <br />tendent" is hereby defined as the individual present on the job site <br />at all times while work is being performed, and whose primary <br />responsibility is to supervise and direct the performance of the <br />Work. <br />ii. The superintendent shall be in attendance at the project site at all <br />times during the progress of the work and his duties as superinten- <br />dent shall be limited to this project only. The superintendent shall <br />supervise and instruct workmen without engaging in the work pro- <br />cess. Should the superintendent be absent temporarily from the <br />project at any time, he shall designate a competent foreman to as- <br />sume duties. During the superintendent's absence the foreman <br />shall not engage in the work process but shall supervise and in- <br />struct only. Likewise, any communications given to the foreman <br />shall be as binding as if given to the Contractor. <br />iii. It shall be the superintendent's responsibility to communicate all <br />matters pertaining to the Work with the Owner and/or Engineer. <br />In case of emergency or safety, superintendent shall communicate <br />directly with the Owner and/or Engineer. No decisions regarding <br />changes in the Work will be made without the Owner's <br />knowledge. <br />iv. Decision making authority and ability. <br />V. Able to demonstrate knowledge of work being installed. <br />vi. Fluent in the English language (i.e. reading, writing and speaking). <br />vii. In possession of mobile telephone at all times. <br />viii. Employed by the Contractor at least six months prior to project <br />commencement. <br />ix. Owner and Engineer approval. <br />X. No later than ten days prior to the pre -construction conference, <br />Contractor shall provide the Owner, in writing, the names of the <br />proposed project manager, job superintendent, and foreman for <br />approval. If he so determines, the Owner, without giving cause, <br />may request an additional name, or names, be submitted for ap- <br />proval. The Owner will notify the Contractor of his acceptance at <br />least 48 hours prior to the pre -construction conference. <br />xi. Once approved, the superintendent will not be changed except <br />with the consent of the Owner unless either prove to be unsatis- <br />factory to the Owner or Contractor, or cease to be in the Contrac- <br />tor's employment. <br />xii. Promotion, transfer, or reorganization within the company will not <br />be an acceptable cause for reassignment of the superintendent. <br />xiii.
