SPECIAL CONDITIONS FOR PERMIT NO. 17-35 <br />FOR <br />45TH STREET BEAUTIFICATION PROJECT <br />(ENCLOSURE OF SUB -LATERAL H-3 CANAL FROM <br />43" AVENUE TO LATERAL H CANAL) <br />1) This permit is issued based on plans prepared by Kimley-Horn, signed and <br />sealed by Brian Good, P.E., dated December 8, 2017. <br />2) Drainage within Sub -lateral H-3 (45t' Street) Canal and within Lateral "H" <br />Canal shall be maintained at all times. <br />To provide a 2" per .24 hour discharge capacity Sub -lateral H-3 (451h Street) <br />Canal will require a by-pass pumping capacity of 9,000 G.P.M. at the westerly <br />(upstream) end of project, increasing to 16,600 G.P.M. pumping capacity at <br />easterly end of project. The proposed construction within Lateral "H" Canal <br />will require a by-pass pumping capacity of 37,700 G.P.M. to provide the <br />normal 2" per 24 hour discharge rate from upstream basin. Any construction <br />within they Lateral "H" Canal should only be attempted during the dry season <br />(December thru May). <br />3) Since there is no alternate discharge or outfall for Sub -lateral H-3 and Lateral <br />"H" Canal upstream basins, drainage must be provided and maintained <br />throughout the construction phase to prevent adverse tailwater or flooding <br />conditions upstream of the project site. Any scheduled temporary blockage of <br />the canals shall be coordinated with David E. Gunter, Superintendent of <br />Indian River Farms Water Control District, (Phone -772-562-2141) on a day- <br />to-day basis. <br />4) If a storm event occurs that exceeds any by-pass pump conveyance capacity, <br />or it is deemed a necessity for flood control by a representative of the Indian <br />River Farms Water Control District, the Contractor shall be prepared to and <br />shall remove any temporary berm, sheeting, etc. blocking said canal <br />immediately following such notification. <br />5) As set -forth in Standard Provisos No. 1 of this permit, the Permittee assumes <br />full responsibility for any construction and operations within the District's <br />canal and right-of-way associated with the issuance of this permit including <br />increased tail-water/flood stages upstream of the project site, and shall save <br />and hold harmless the District from any expense, loss, damage or claim in <br />regards thereto. <br />
