ARTICLE VI <br />OPERATION, MAINTENANCE AND <br />EXPANSION OF THE SEBASTIAN UTILITY SYSTEM <br />SECTION 6.01. COVENANTS EFFECTIVE UPON CLOSING. Only upon <br />the purchase, sale, transfer and assumption of the Sebastian <br />Utility System as contemplated herein shall the covenants and <br />provisions contained in this Article become effective. <br />SECTION 6.02. RATES, FEES OR OTHER CHARGES. <br />(A) To the extent permitted by law, the uniform county <br />utility policies shall apply within the City and there shall be no <br />discrimination between City and County residents. All rates, fees, <br />and charges for water and sewer service shall be established <br />exclusively by the County. At no time shall rates, fees, and <br />charges, including the rate equalization charge, for any class or <br />user or property owner within the City exceed the total charged by <br />the County, including the County's franchise fee, for a comparable <br />class of users or property owners within the unincorporated areas <br />of the County. <br />SECTION 6.03. PUBLIC SERVICE TAX. <br />(A) The City at all times shall have the power and authority <br />to impose and levy any public service tax now or hereafter <br />authorized on the purchase of water and, to the extent permitted <br />by law, the County shall collect such public service tax at the 19, <br />time of payment for such service.
