(B) The County shall not impose a tax on the purchase of <br />water or wastewater services within the City. <br />SECTION 6.04. LICENSE TO USE CITY RIGHTS -OF -WAY - <br />(A) The City hereby grants and conveys to the County a <br />license to use all City rights-of-way now or hereafter acquired by <br />the City for the purpose of providing water and wastewater <br />services. However, such a grant shall require the County to <br />relocate any water or wastewater utility facilities in the event <br />that such facilities interfere or are inconsistent with the use of <br />the City rights-of-way for transportation or drainage purposes. <br />(B) The City, on application from the County, shall grant the <br />County a written permit to locate water and sewer lines within the <br />City right-of-way. Upon the City granting such written permit to <br />the County, notwithstanding the above language, if the City <br />requires the County to remove its lines within a permitted right- <br />of-way within five (5) years after the issuance of the permit, the <br />City shall pay for the cost of the relocation of such lines. <br />(C) The license granted and conveyed to the County hereunder, <br />shall include by way of example and not limitation, the authority <br />and obligation to construct, maintain, repair, replace, operate, <br />remove and relocate water and wastewater utility facilities. In <br />doing so the County shall cause as little disruption to the public <br />as possible, shall attempt to prevent the creation of obstructions <br />or conditions dangerous to the public, and shall promptly repair <br />any damage to or disruption of public or private property. <br />18 of 28 <br />CD <br />C� <br />cz <br />
