Board of County Commissioners <br />Meeting Minutes - Final January 14, 2020 <br />13.C. 19-1216 <br />County Attorney Dylan Reingold presented the item and stated that David W. <br />Morgan was the only applicant who had applied to fill the "BCC Appointee" <br />vacancy on the Beach and Shores Preservation Advisory Committee. <br />Vice Chairman Flescher made mention of the date the vacancy was advertised and <br />that there had been several holidays in the past two (2) months. It was the <br />consensus of the Board that they would table the item until February 2020 to see if <br />any additional applications were received. <br />Tabled <br />Necessity of Take Resolution for parcel of property located at 4740 58th Avenue, <br />Vero Beach, FL, owned by Paulette Brown <br />Recommended Action: Staff recommends that the Board approve the Resolution of Necessity and authorize <br />staff to proceed with the necessary right-of-way acquisition through the County's <br />power of eminent domain. <br />Attachments: Staff Report <br />Sketch of Brown Parcel <br />Resolution <br />Sketch and legal for right-of-way <br />Deputy County Attorney William DeBraal presented the background related to the <br />County's acquisition of a parcel of property located at 4740 58th Avenue. He <br />clarified that the attached Necessity of Take Resolution was a requirement in the <br />eminent domain process. <br />A motion was made by Commissioner O'Bryan, seconded by Vice Chairman Flescher, <br />to approve staff's recommendation and Resolution 2020-006, declaring a reasonable <br />necessity to acquire certain real property for the purposes of improving and <br />reconstructing 58th Avenue, including side street, intersection, sidewalk and water <br />retention pond improvements; authorizing the County Attorney to acquire the <br />attached property by the institution of proceedings in eminent domain, and providing <br />an effective date. The motion carried by the following vote: <br />Aye: 5 - Chairman Adams, Vice Chairman Flescher, Commissioner Zorc, Commissioner <br />O'Bryan, and Commissioner Solari <br />14.
