PF - <br />Boa 94 PAGI0 <br />County's definition of administrative permit use and commented on <br />the Board's power according to the Land Development Regulations to <br />control the location of uses: He declared there was only one basis <br />for appeal that applied: Did the PZC fail to consider adequately <br />the effects of the proposed development upon surrounding <br />properties, traffic circulation, or public health, safety and <br />welfare? He suggested they did not. <br />Mr. O'Haire granted that the Board had heard a lot of emotion <br />from the people, but they also had heard facts about the effects of <br />a mining operation, and trucks, and that it was the wrong <br />neighborhood. <br />Chairman Macht announced that it was now time for the Board to <br />hear the case of the appellee. <br />Dean Luethje, engineer from Carter Associates and representing <br />the applicant, Jenkins Trucking, Inc., informed the Board that <br />Brian Jenkins, the owner, was unable to be present due to previous <br />commitments out of town, so he would be addressing some of the <br />comments. He thought the owner of the property, Mr. Koehler, also <br />might like to comment. <br />Mr. Luethje continued that SJRWMD claimed the furrows in the <br />citrus groves were the only "wetlands" they would be destroying and <br />they had mitigated for those furrows around the lake, as required <br />and permitted by the County. They also had a permit from the <br />SJRWMD. <br />Mr. Luethje then advised that the height of the spoil area had <br />been stated at 501, but that was from sea level. Actually, the <br />fill would rise only approximately 27 feet high from ground level. <br />Mr. Luethje wished to address the groundwater issue and agreed <br />with Mr. Davis' description of the hydraulic mining operation. He <br />added, however, that the water table elevation would not be <br />changed. The big issue seemed to be the quality of the water and <br />he disagreed with the statement that SJRWMD had no expertise in <br />groundwater. As a registered engineer in Florida, Mr. Luethje <br />believed they do have some knowledge in groundwater. He had <br />discussed the project three or four different times with Rich <br />Burklew in the Melbourne office who said there was no way they <br />could contaminate the neighboring wells. They have required that <br />a geologist be retained to monitor the installation of the <br />monitoring well and probably will require that a hydrologist also <br />look at the aspect of the well. The exact location of the well has <br />not been determined and it may be that it will be located closer to <br />the lake.
