Mr. Kraft advised that with regard to the issuance of a <br />permit, he doesn't preclude appeals of any affected parties. Most <br />of the burden will lie with the County. He didn,'t want to minimize <br />the possibility of a hearing which sometimes can go a year or more <br />and carry a great deal of expense. <br />Commissioner Adams inquired about the time frame for obtaining <br />the permit, noting that Mr. Woodruff took the full 30 days to reply <br />to us. <br />Mr. Kraft explained that through the normal process we still <br />would be arguing completeness. He thought one of the issues for <br />completeness is the experimental test plan, and he would suggest <br />that we endeavor to try and solve that within 30 days and schedule <br />the permitting. He felt that he could commit to assuring the time <br />for him and his staff to get together to work that out. As soon as <br />that is done, it would take another 30 days to get out the <br />necessary intent to issue in order to provide the public notice. <br />Commissioner Bird asked about the test plan, and Mr. Kraft <br />explained that the design of the test plan is accomplished before <br />the permitting. The monitoring goes forward after construction. <br />Commissioner Bird understood from Paden WoodrufffIs letter that <br />the County would not be allowed to add sand during the monitoring <br />stage without jeopardizing the project, and Mr. Kraft confirmed <br />that to be the case. He recalled that after last year's huge storm <br />the DEP did allow sand to be replaced on the beach in order to <br />protect the public's investment along the shore. The addition of <br />sand will alter the monitoring results. If there was a mechanism <br />by which we could account for that addition of sand, he would be <br />glad to consider that because he felt the County would like the <br />flexibility of adding sand under certain circumstances. He would <br />have to rely on his staff to see if they could come up with a plan <br />that would allow us to alter that variable. He rather doubted that <br />there is a possibility, but he is open to considering it. <br />Commissioner Adams noted that we already have submitted a test <br />plan and that Mr. Kraft's staff is in disagreement on just a few <br />items for one reason or another. She believed that could be <br />settled in 2 weeks rather than 30 days, if, in fact, the D.E.P. is <br />willing to work with the County. County staff has worked hard in <br />an effort to have a quality monitoring plan, and if money means <br />quality, we certainly have a quality plan. <br />31 eo®K 94 KUL 713 <br />MARCH 28, 1995 <br />
