0 <br />BOOK N�t�i�r. <br />ANALYSIS: <br />The LDRs allow developers to "plat over" site plan projects to <br />provide for the fee simple transfer of property beneath individual <br />units. Normal subdivision lot dimension and roadway requirements <br />are waived for "lots" created by such plats. The approved site <br />plan controls the development of the project, including setbacks <br />and separation between structures, while the plat delineates common <br />areas and creates lots that can be sold to unit owners. <br />All required improvements have been completed by the developer with <br />the exception of streetlighting, which will be bonded -out for <br />future construction. The cost estimate for streetlighting has been <br />approved by the county engineer, and the contract for construction <br />and cash escrow agreement has been approved by the County <br />Attorney's Office. The developer has obtained a certificate of <br />completion certifying that all required improvements are complete <br />and acceptable, with the exception of the streetlights. All <br />proposed subdivision improvements are to be privately dedicated <br />with the exception of the utilities, which is separately warranted <br />through the Department of Utility Services. Therefore, no warranty <br />and maintenance agreement is required. All requirements of final <br />plat approval have been satisfied. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners authorize the Chairman to sign the contract <br />for construction of required improvements, and approve the final <br />plat. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously granted <br />final plat approval to Brandon Capital Corp. for <br />Village of Lexington at Lake -in -the -Woods and <br />authorized the Chairman to sign the contract for <br />construction of required improvements. <br />CONTRACT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />8 <br />APRIL 18, 1995 <br />
