ALTERNATIVES AND ANALYSIS <br />The waiver request has been reviewed by staff and appears to meet the criteria of Section <br />930.07(2)(d)4. of the Stormwater Management and Flood Protection Ordinance for lots <br />located in the Vero Lake Estates Municipal Services Taking Unit. The applicant has also <br />submitted an alternative grading plan that satisfied the cut and fill balance requirement <br />without needing the waiver. The alternative plan was approved with the Type C Flood <br />Management System Permit on April 13, 1995. The applicant is requesting the waiver so <br />he will have the option of not constructing an on site retention area if the waiver is granted. <br />Alternative No. 1 <br />Grant the cut and fill balance waiver based on the criteria of Section 930.07(2)(d)4. <br />Alternative No. 2 <br />Deny the cut and fill waiver. Require an on site retention area be provided to compensate <br />for the proposed floodplain displacement. <br />RECOMMENDATION <br />Staff recommends approval of Alternative No. 1. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously approved <br />the cut and fill balance waiver for Lot 5, Block 15, <br />Vero Lake Estates, Unit 3, as recommended by staff. <br />H. 1st Street SW Right -of -Way Acquisition - Du -1's.
