DESCRIPTION AND CONDITIONS <br />Two sites listed by the County Land Acquisition Advisory Committee <br />(LAAC) for acquisition are the Korangy Tract on north Jungle Trail <br />and the Fischer property on the south prong of St. Sebastian River <br />("Sebastian Creek"). Both of these sites have generally been <br />approved for cost -share funding under the State Conservation and <br />Recreational Lands (CARL) program. <br />For each cost -share project under the -CARL program, a multi-party <br />acquisition agreement is required between the County and the <br />Division of State Lands (DSL). In fact, execution of a <br />County/State multi-party acquisition agreement is a condition of <br />closing the Korangy Tract purchase contract recently approved by <br />the Board. <br />Over the past few months, county staff has coordinated with DSL <br />staff to finalize the wording of the referenced multi-party <br />acquisition agreements. These agreements are based on a standard <br />State format, with certain site-specific language. <br />Staff requests that the Board approve the attached multi-party <br />acquisition agreements relating to state cost -share acquisition of <br />the Korangy Tract and the Fischer -Sebastian River Property LAAC <br />sites. <br />ANALYSIS <br />Korangy Tract <br />The eastern +15 acre parcel of the Korangy Tract is within the <br />Archie Carr CARL project boundary, and is generally the portion of <br />the Korangy LAAC site subject to the multi-party agreement. More <br />specifically, 11.33 acres of the eastern parcel are landward of a <br />water boundary line depicted on the certified boundary survey of <br />the parcel, as approved by the DSL. These.11.33 Acres are the <br />portion of the Korangy Tract that the State is agreeing to <br />purchase. <br />The Agreement provides that the County will assume responsibility <br />for pre-acquisition tasks such as appraisal mapping, appraiser <br />selection, and negotiations, all in accordance with State DSL <br />procedures. During the course of these activities, which have <br />already occurred, county staff coordinated with DSL staff to ensure <br />that State procedures were satisfied. <br />The Agreement also provides that the State will pay closing costs <br />for that portion of the overall Korangy Tract within the Archie <br />Carr CARL project boundary. "Closing costs" includes survey, <br />environmental audit, title insurance and recording costs. <br />Under the heading of "special conditions", the Agreement has a <br />disclaimer that the State's purchase participation is contingent <br />upon available State funding. However, given that the Archie Carr <br />CARL project is ranked 3rd on the State CARL project list and has <br />been funded under the FY 94/95 DSL acquisition work plan, non - <br />participation by the State is remote. <br />Fischer -Sebastian River Property <br />The multi-party agreement relating to the Fischer -Sebastian River <br />property is similar to the Korangy Tract agreement. A difference is <br />that, since the total property is within the Sebastian Creek CARL <br />project boundary, the State is agreeing to cost -share for the <br />overall property.
