SCHEDULE PUBLIC HEARING TO CONSIDER LOCAL OPTION <br />GAS TAX DISTRIBUTION METHOD <br />The Board reviewed the following memo dated 6/21/95: <br />TO: James E. Chandler, <br />County Administrator <br />FROM: James W. Davis, P.E., <br />Public Works Director <br />SUBJECT: Local Option Gas Tax (LOGT) - Request for Public Hearing <br />DATE: June 21, 1995 <br />DESCRIPTION AND CONDITIONS <br />In January, 1995, the County Public Works Department requested each of the five <br />municipalities to submit figures for their town's transportation expenditures for <br />the past five (5) years, number of lane miles of roadways under each <br />municipality's jurisdiction, and number of bridges in their jurisdiction. These <br />figures have been received and inserted into the Local Option Gas Tax formula <br />agreed upon in 1985. <br />The enclosed table summarizes the data received and includes a new distribution <br />percentage. Staff intended to report the revised percentages to the State for <br />updating distribution. In late 1994, the State Legislature changed the LOGT <br />distribution procedure by requiring the County to hold a Public Hearing on the <br />distribution method every two years if the past interlocal agreements with the <br />municipalities do not provide for local governmental periodic review -of the <br />distribution method. The 1991 executed agreements between the county and <br />municipalities do not provide for this review. On August 31, 1996, the first 10 <br />year period of LOGT implementation will terminate and the Board will have to <br />consider reauthorizing the program. <br />RECOMMENDATIONS AND FUNDING <br />Instead of changing percentages at this time, staff recommends scheduling a <br />Public Hearing on Sept. 12, 1995 to consider the LOGT Distribution Method and <br />receive public comment on extending the program beyond August 31, 1996. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Eggert, the Board unanimously scheduled <br />a public hearing on September 12, 1995, as <br />recommended by staff. <br />70 <br />JUNE 279 1995 .
