ANALYSIS: <br />At this time, none of the required subdivision improvements has <br />been completed. A contract for construction for all of the <br />required subdivision improvements., along with a letter of credit to <br />secure the contract, have been submitted,by the applicant. The <br />county engineering division and the utility services department <br />have approved the cost estimate, and have verified that the letter <br />of agreement amount is adequate to cover the estimated cost of the <br />remaining required improvements. The county attorney's office has <br />approved the construction contract for legal form and sufficiency <br />and has approved the format of the letter of agreement. The letter <br />of agreement will be finalized prior to the recording of the plat. <br />All applicable requirements regarding final plat approval have been <br />satisfied. Pursuant to the county's LDRs, the applicant will be <br />required to obtain a certificate of completion, after completion of <br />the required improvements. At that time, the applicant will <br />warranty the utility improvements via a Utility Services department <br />Bill of Sale. Since no other improvements are being dedicated to <br />the public, no other warranties are required. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners grant final plat approval for Sixty/95 <br />Commercial Subdivision and authorize the chairman to sign the <br />contract for construction and the letter of agreement. <br />Commissioner Bird announced a conflict of interest and filed <br />the necessary form with the Clerk's office.
