UNw=- I e
IfI
Chairman Ginn asked that staff work on this to try to reach an amiable solution .
s More suggestions were offered by the Commissioners .
Director Keating thought the cost issue to be the problem on the part of Riverpoint .
x
If Deputy County Attorney Collins advised that the real issue from the legal point- of-
view is the life - safety issue . He had met with Mr . and Mrs . Esposito as to the location of the
gate .Mr . Esposito is frustrated and wants to keep people out of his driveway . Riverpoint ' s
s
gate is on the right- of-way and was permitted .It may be possible to give Mr . Esposito a
k
special permit to put in a gate or extend his fence on the right- of-way ; or perhaps the County
Ile, I can allow him to chain his driveway or somehow preclude people from using it . With regard
F,
Y,to a suggestion that the County explore a cul - de- sac in that 70 ' right- of-way, the Espositos
and their neighbor, Mrs . Huber, might feel that is their " front yard " even though it is a
grassed right- of-way .He did not know if 70 ' is enough ; the traffic engineers will have to
study that . He realized it is very rare to grant a license to have something in a public right-
of-way .There was only one time he could remember when a well was allowed to remain
on right- of- way property . Perhaps because this is a unique situation , a permit or license
could be granted to occupy public right- of-way subject to a covenant that the installation be
removed if necessary .He thought it would be worth staff exploring .
Chairman Ginn asked staff to come up with some problem - solving ideas .
Linda Huber, 653 23 d
Street SE , 32962 , spoke ofthe project ' s beginnings when she
asked about the orange markings on her property . She was advised that would be a
turnaround .From that day she documented what she called "the runaround " . She finally
got Commissioner Tippin to come out with Director Davis to meet with the neighbors .ThatY .
resulted in her not having a turnaround on her property and a sign was put at
61 Avenue SE
saying there was no turnaround, which is not effective . She also spoke about the gate not t ;
working , speeding cars , and thanked the Board for their time .
If
If
October 16 , 2001
If
134
If0
f
NAN
J .. fi
d a,
atm '
r
5 M
t y, r t . . .
a'
