Cain, P <br />County Engineer <br />SUBJECT: Wentworth Ditch <br />DATE: November 21, 1995 <br />DESCRIPTION AND CONDITIONS <br />r <br />Agreement <br />Staff has been working with the city of Sebastian's staff and <br />attorney to devise a maintenance agreement for the area of CR 512 <br />to which the new road discharges and conveys the stormwater from <br />the county right of way. The subject agreement is the result. It <br />sets out the terms for maintenance which are, except for specific <br />responsibilities as to treating with herbicide and mowing, to <br />equally share the responsibility for maintenance. The agreement <br />spells out the territorial extent of maintenance as well. <br />ALTERNATIVES AND ANALYSIS <br />Alternative 1: <br />Approve the agreement and direct the chairman to execute the <br />agreement on behalf of the county and direct staff to submit the. <br />agreement to the city for their consideration. <br />Alternative 2: <br />Not approve the agreement and direct staff to revise the agreement <br />in specific ways. <br />RECOMMENDATION AND FUNDING <br />Staff recommends Alternative 1, funding to be from account number <br />111-214-541-033.49 <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Bird, the Board by a 4-0 vote <br />(Commissioner Eggert being absent) unanimously <br />approved the Interlocal Agreement with the City of <br />Sebastian for the 'purpose of providing for the <br />maintenance of CR -512 Wentworth and Blossom Ditches, <br />as recommended by staff. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD <br />]DECEMBER 5, 1995 42 <br />
