BK: 3615 PG: 1116 <br />Eighth Draft Clean Version <br />11/07/2022 <br />-2- <br />NOW THEREFORE, in consideration of the mutual advantages afforded to the Parties, the <br />Trustees, the Counties, and the ME agree as follows: <br />1. General. This Agreement is entered into pursuant to Section 163.01, Fla. Stat., the <br />Florida Interlocal Cooperation Act. <br />2. Recitals. These Parties adopt and ratify those matters set forth in the foregoing recitals. <br />3. Lease of Trustees' Property. The Trustees agree: <br />a. To expeditiously negotiate a long-term lease of the Property with the Counties <br />and ME of not less than 30 years with a 30 -year renewal option. <br />b. The proposed lease shall be a separate document executed by all Parties. <br />c. The proposed lease shall include an annual rental fee of $1. <br />d. The proposed lease shall provide that the New Improvements become the <br />Trustee's facilities at end of the agreed upon lease term or upon the abandonment <br />of the use of the Property and New Improvements by the ME and the Counties <br />(the "Non -Trustees Parties"). <br />e. To share with the Non -Trustees Parties all available property surveys, <br />explorations, assessments, and reports pertaining to the Property. <br />f. The State of Florida Building Code and the Florida Fire Prevention Code apply to <br />the new medical examiner's office on the Property. St. Lucie County shall <br />coordinate with the City of Fort Pierce and/or the Trustees on the approval <br />mechanism for the new medical examiner's office, as the property is located <br />within the jurisdiction of the City and on the property of the Trustees. To the <br />extent applicable, the Parties agree to request that the applicable agencies waive <br />impact fees as allowable by local ordinance or state law. <br />4. Budgets and Contract Administration. <br />a. Phased Approach and Overall Design <br />I. The Non -Trustees agree that the design of the New Improvements shall <br />proceed using a phased approach. <br />ii. Phase 1 shall be a Space Needs Analysis, which shall examine the ME's space <br />needs, provide conceptual planning for the medical examiner's office and its <br />related site improvements, and provide cost estimates. <br />
