Board of County Commissioners Meeting Minutes - Final October 18, 2022 <br />Assistant County Administrator Mike Zito introduced the new Parks and <br />Recreation Assistant Director Gustavo Vergara. Mr. Vergara stated that in July <br />2022, Governor Ron DeSantis signed House Bill 105, authorizing Counties and <br />Municipalities to further restrict smoking within the boundaries of public beaches <br />and public parks under certain circumstances. He stated many municipalities had <br />already done so. Mr. Vergara requested permission to advertise for a public <br />hearing to amend the County's Code. <br />There was no further discussion on this Item. <br />A motion was made by Commissioner Flescher, seconded by Vice Chairman <br />Earman, to approve staffs recommendation. The motion carried by the <br />following vote: <br />Aye: 5- Chairman O'Bryan, Vice Chairman Earman, Commissioner Adams, <br />Commissioner Flescher, and Commissioner Moss <br />D. Utilities Services <br />12.H.1. 22-0881 Recommendation for Mandatory Connections <br />Recommended Action: Staff recommends the Board of County Commissions instruct the Indian River <br />County Department of Utility Services work with the County Attorney's office, <br />Budget Office and the Tax Collector's Office to evaluate these options and bring <br />forth proposed changes to County Code in accordance with the appropriate <br />administrative procedures. Any proposed ordinance changes would be <br />accompanied by a corresponding guidance document to assist staff and citizens <br />with understanding the requirements <br />Attachments: Staff Report <br />Director of Utility Services, Sean Lieske brought before the Board a discussion <br />item for mandatory sewer connections. He stated the Policy approved in <br />November 2018, included a septic to sewer policy which had not been <br />consistently enforced. Using a PowerPoint presentation, Mr. Lieske outlined the <br />following recommendations to consider for further development: 1) Must connect <br />within three (3) years of water/sewer becoming available; 2) in order to receive <br />sewer service, homeowners must also connect to water; 3) set aside funding in <br />each year's budget to assist with low-income and disadvantaged homeowners; 4) <br />Indian River County Florida Page 12 <br />
