ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />D.M.G. to review and evaluate fire hydrant fees at a <br />cost of $9,500. <br />ARMY CORPS OF ENGINEERS CONSENT TO EASEMENT <br />FOR COUNTY OPERATION OF BOAT CLUB ISLAND <br />(IR25 SPOIL ISLAND <br />The Board reviewed the following memo dated 2/13/96: <br />TO: James E. US Department ofthe Army Corps of Engineers Consent to Easement for County <br />Operation of Boat Club Island (IR25 Spoil Island) <br />REF. LETTER: Bart Wivell. USACOE to Lea Keller dated Feb. 2, 1996 <br />DATE: February 13, 1996 <br />DESCRIPTION AND CONDITIONS <br />On Oct. 17, 1995. the Board authorized staff to investigate entering into an agreement <br />with the State allowing the Parks Division to maintain the picnic facilities on Boat Club <br />Island (IR #25) located in the Indian River just north of Grand Harbor. The volunteer <br />club which developed the island can no longer maintain it, however, the club is willing <br />to donate $1000 for repair of the existing facilities. <br />Staff has received a copy of a Dept. of Army COE Consent to Easement agreement <br />authorizing the County to operate and maintain a public recreational facility on the <br />island. <br />ALTERNATIVES AND ANALYSIS <br />The attached Consent to Easement includes the following conditions <br />1) County must obtain permission from any owners of the land other than the US <br />Government. The State is only party affected. <br />2) All improvements and use must be approved by COE, at no cost to COE <br />maintained by County, and shall not conflict with US Government uses. <br />3) The US Government will have no liability. <br />4) If and when County terminates use of the island, the County will remove all <br />improvements if requested. <br />5) County will not remove or disturb historical. archeological, or cultural artifacts <br />or objects. <br />6) No commercial use is allowed, including permanent moorings. <br />Alternative No. 1 <br />Approve the Consent to Easement and authorize 'rhe Chairman's <br />signature. <br />Alternative No. 2 <br />Deny approval. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends Alternative No. 1 whereby the Chairman is authorized to <br />approve the Consent to Easement.
