Approval Needed Reviewing Body <br />1. Conceptual Plan/Special Exception PZC & BCC <br />2. Preliminary PD Plan PZC <br />3. Land Development Permits or Waiver* Staff <br />4. Final PD Plat BCC <br />The applicant is now requesting approval of the first two steps. <br />If the PD special exception use request is approved by the Board of <br />County Commissioners, the Planning and Zoning Commission's approval <br />of the preliminary PD plan will become effective, and the applicant <br />will then need to obtain a land development permit for the required <br />PD infrastructure improvements. It should be noted that the <br />applicant has already submitted a land development permit <br />application for staff review. <br />•Planning and Zoning Commission Consideration <br />At its January 25, 1996 meeting, the Planning and Zoning Commission <br />voted 4 to 2 to: <br />• conditionally approve the preliminary PD plan subject to Board <br />of County Commissioners approval of the special exception use <br />request, and <br />• recommend that the Board of County Commissioners approve the <br />special exception use. If the Board of County Commissioners <br />approves the special exception use, the preliminary PD <br />plan/plat will automatically become effective. <br />In addition to staff's originally recommended conditions, the <br />Planning and Zoning Commission recommended that the substance of an <br />agreement between Beazer Homes and Marbrisa Property Owners be <br />incorporated as a condition of approval (see attachment #9), and <br />recommended that the lots along the west project perimeter meet all <br />RS -6 zoning district lot size and dimension standards. The <br />conditions related to the agreement with the Marbrisa Property <br />Owners address the proposed development's impact along the south <br />property line. In addition, the developer agreed to revise the <br />project design adjacent to Baytree to include 70' wide lots that do <br />not require any waivers and a 10' wide Type "C" buffer. These <br />revisions have been incorporated into staff's recommendation. <br />ANALYSIS: <br />1. Size of Development: 42.94 acres overall <br />2. Zoning: <br />RM -61 Residential Multi -Family <br />(up to 6 units/acre): 0.81 acres <br />RS -6, Residential Single Family <br />•(up to 6 units/acre): 33.63 acres <br />A-1, Agricultural District <br />(up to 1 unit/5 acres): 8.30 acres <br />TOTAL 42.94 acres <br />3.
