Page 6 of 8 <br />Issue B: Material Price Increases to Asphalt Items <br />VIII. Entitlement Analysis <br />The purpose of this Change Order is to increase the Contract by $460,147.50 for material price <br />escalations beyond the Contractor's control, in accordance with General Condition 12.01 of the <br />Contract. This Change Order will provide compensation to the Contractor for the increased asphalt <br />prices in contract pay items 0286-2 Turnout Construction-Asphalt/Driveway Base -Asphalt Material; <br />0337-1-13 (Superpave AC Traffic C Overbuild); 0334-1-13A Superpave AC Traffic C, PG 76-22 <br />(w/polymer); and 0337-7-82 AC Friction Course FC -9.5. <br />The Contractor experienced significant delays to the project caused by relocation delays by FPL and <br />added work at the FDOT's request, namely the 54" diameter storm pipe that required urethane <br />injecting the voided areas — see Issue A. These delays along with weather and holiday time <br />extensions have pushed the construction of the asphalt approximately 300 days beyond their <br />originally planned performance period and into a period of unusually high inflated costs. In <br />accordance with General Condition 12.01 of the Contract, this Change Order will account for the <br />increased costs for the remaining asphalt concrete to be placed on the project. <br />IX. Time Analysis <br />This issue is a price escalation issue and time is not warranted nor requested by the Contractor. <br />X. Engineer's Estimate <br />a. Basis of Estimate <br />For the Engineer's Estimate, recent FDOT Bid Tabulations were used and applied to the estimated <br />remaining quantities of asphalt concrete required to complete the project. <br />b.
