C. Extension of Windsor Phase H Planned Development Land <br />Development Permit <br />The Board reviewed the following memo dated 6/11/96: <br />TO: James Chandler <br />County Administrator <br />THROUGH: James W. Cox, P.E 4bc <br />Civil Engineer <br />L71 <br />SUBJECT: Request for Extension of Windsor Phase 11 Planned Development Land <br />Development Permit <br />REFERENCE: PRD-91-05-03/L.D.P. No.109 <br />DATE: June 11, 1996 CONSENT AGENDA <br />DESCRIPTION AND CONDMONS <br />Knight, McGuire & Associates on behalf of Windsor Properties, Inc. has requested an <br />extension of the subject land development permit in the attached letter dated June 3, 1996. <br />The subdivision is located on the barrier island approximately two miles north of CR510 on <br />the west side of SR A -1-A. The land development permit plans approved on July 19, 1991 <br />depict two sub -phases of construction, Phase IIA and Phase IIB. A Certificate of <br />Completion for Phase IIA was issued on September 23, 1992. Only the storm sewer and <br />sanitary sewer improvements were constructed for Phase IIB. The remaining roadway, water <br />distribution, non -potable water and traffic control improvements for Phase IIB have not <br />been completed. <br />ALTERNATIVES AND ANALYSIS <br />Section 913.07(5)(J) of the Subdivision and Platting Ordinance allows the Board of County <br />Commissioners to grant an extension of time for land development permits. The expiration <br />date of land development permits is eighteen months from the date of issuance regardless <br />of whether or not the work is complete. Accordingly the land development permit for <br />Windsor Phase n Planned Development, expired on January 19, 1993. The applicant has <br />recently submitted plans to include Phase IIB as part of Windsor Plat 9. These plans are <br />now under review by staff as Land Development Permit Application No. 95110114006 <br />which also includes area east of SR A -1-A approved as the preliminary plat for Windsor <br />Beachside Plat 10 and a portion of the Windsor Phase V preliminary plat west of SR A -1-A. <br />Alternative No. 1 - Grant an eighteen months extension of the land development permit. <br />Alternative No. 2 - Deny the extension and require the developer to re -apply for preliminary <br />plat approval and land development approval. <br />RECOMMENDATION <br />Staff recommends approval of Alternative No. 1. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously granted an <br />18—month extension of the land development permit, <br />as recommended by staff. <br />8 <br />JUNE 189 1996 <br />600K c70 FA�E•,��� <br />
