PEP Reef - Submerged Breakwater <br />File No. 312428049 <br />Indian River County, Vero Beach, Florida <br />Dear Eric: <br />6 <br />As discussed during our phone conversation on February22, 1996, the <br />Indian River County Board -of County Commissioners requested the County staff <br />to contact your office regarding the long term agreement required by the Wetland <br />Resource Permit Specific Condition 13. The draft agreement. which was <br />transmitted to the County last Apra 1995, contains language in paragraph 4 and <br />5 that req the County to perform mitigation due to sand accretion seaward <br />of the n�f air requires <br />erosion. There are no time limits on this requirement The <br />County s concerned that these conditions will apply in perpetuity long. after the <br />Project is in place. that <br />storms or other factors may contribute to seasonal <br />seaward accretion of sand and downdrift erosion. The County would request that <br />the language be modified to contain a three (3) year or five (5) year time limit on <br />these conditions. <br />During our phone conversation, you stated that this changge may be <br />appropriate, and suggested that perhaps the long term agreement couldbe revised <br />and executed after the reef is installed this summer once the first s <br />construction monitoringg survey was complete.
