r � <br />BOOK 98 m-150 <br />The developer is now requesting final plat approval and has <br />submitted the following: <br />1. A final plat in conformance with a portion of the approved <br />preliminary plat. <br />2. A contract for construction for remaining required <br />improvements. <br />3. An engineer's certified costestimate. <br />4. Financial security acceptable to the county attorney's office. <br />.ANALYSIS: <br />All required subdivision improvements have been completed by the <br />developer with the exception of some minor improvements and a <br />double frontage buffer along West Sandpoint Lane. This buffer was <br />a condition of preliminary plat approval (see attachment #3). <br />Consistent with the preliminary plat approval condition, a buffer <br />has been constructed along West Sandpoint Lane by St. Edwards. <br />This buffer can satisfy the developer's requirement for the double <br />frontage buffer, provided the developer can document the legal <br />ability to guarantee maintenance of the buffer. <br />It- is anticipated that, prior to the July 9th Board of County <br />Commissioners meeting, the developer will secure a landscape <br />easement over the existing buffer, which will satisfy the <br />preliminary plat condition. It is staff's understanding from <br />conversations with the parties involved: that the provision of the <br />landscape easement will result in additional plantings in the berm. <br />The easement will be dedicated to the Sandpoint Property Owners <br />Association and will provide the right but not the obligation to <br />maintain the buffer. The buffer will be maintained by St. Edwards. <br />An engineer's certified cost estimate for completion of the <br />remaining improvements has been reviewed and approved by the public <br />works department. Besides the cost estimate, the developer has <br />submitted a Contract for Construction of Required Improvements and <br />posted suitable security, approved by the county attorney's office, <br />to guarantee the contract. The contract, which is on a standard <br />form approved by the county attorney's office, is to be executed by <br />the developer prior to the July 9, 1996 Board meeting date. <br />RECOMMENDATION: <br />Given the above analysis, staff recommends that the Board of County <br />Commissioners grant final plat approval for Sandpoint Phase II <br />Subdivision and authorize the Chairman of the Board of County <br />Commissioners to sign the contract for construction. <br />In response to Vice Chairman Eggert's inquiry, Community <br />Development Director Bob Keating advised that the condition had <br />been satisfied and the item could remain on the Consent Agenda. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Tippin, the Board unanimously approved <br />Sandpointe West L.C.'s request for final plat <br />approval for Sandpointe West Phase II, as <br />recommended in the memorandum. <br />CASH DEPOSIT AND ESCROW AGREEMENT AND CONTRACT <br />PLACED ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />12 <br />July 9, 1996 <br />0 <br />
