BUTLER, CLERK <br />Attachment A — SCOPE OF WORK <br />Project Name: Indian River County BOCC Derelict FWC Contract No. 23214 <br />Vessel Removal Project <br />4) Case #: FWC220N0069531 <br />Description: White 42' Gulfstar Sailboat, Reg: FL0931 TA <br />HIN: CFSO44650474 <br />Location: 27 50.5899 (N) / 80 26.4210 (W), Sebastian Inlet State Park <br />Disposal: Dispose of in authorized landfill facility <br />ii. Minimum Level of Performance — The vessels and all parts of the vessels listed <br />above shall be completely removed from the waters of the State and all parts of the <br />vessels shall be disposed of as provided. <br />As part of satisfactory completion of this Agreement, the Grantee shall provide to the <br />Commission all documentation required by Attachment H (Grantee's Required <br />Documentation Submission List) at or before the time stated in Attachment H. <br />iii. Documentation / Criteria Used as Evidence of Performance - The Grantee shall <br />provide to the Commission a Final Disposition Report. This report shall contain the <br />list of all derelict vessels removed, the disposition of each derelict vessel, and <br />photographs that document the condition of each vessel prior to removal, the removal <br />process for each vessel, and the final disposition of each vessel. <br />B. Timeline for Completion - Final receipts with required evidence of completion will be <br />received by the Commission's Grant Manager no later than 4/22/2024. <br />C. Acknowledgment by Grantee's Contractors: For each vessel removed and disposed of <br />pursuant to this Agreement the Grantee shall provide to the Commission written <br />acknowledgement from all of Grantee's contractors of receipt of a copy of this Agreement. <br />Such acknowledgment(s) may be emailed to the Grant Manager and must be received before <br />any work begins under this Agreement. Failure to submit such acknowledgment(s) may <br />result in delays in reimbursement of the Grantee. <br />3. FINANCIAL CONSEQUENCES <br />In addition to nonpayment for tasks which are not satisfactorily or timely completed, or for failure to <br />correct any project deficiencies, as noted in the final project inspection, the Commission may impose <br />a financial consequence of twenty percent (20%) of the total contract amount for failure to complete <br />any tasks satisfactorily or timely, or for failure to correct any project deficiencies, as noted in the final <br />project inspection. <br />The final project inspection will be done by a Commission officer verifying that the entire vessel for <br />each task has been removed according to the project plan. <br />Failure of Grantee to have all receipts and evidence of project performance delivered to FWC on or <br />before 4/22/2024 before close of business may jeopardize payment of funds to the Grantee per the <br />Agreement. <br />4.
