Indian River County Solid Waste Disposal District <br />Solid Waste and Recyclables Franchise Agreement <br />7.1.3 Franchisee may charge a Fee, not to exceed fifty dollars ($50.00) to a Commercial Customer for <br />resumption of service, where Franchisee had discontinued service because the Commercial Customer became <br />delinquent in payments. <br />7.1.4 Franchisee shall not charge Customers any additional rates, surcharges, or Fees of any kind other than <br />those specifically provided herein. <br />7.2. General Collection Procedures <br />7.2.1. Franchisee shall provide Commercial Collection Service in the Solid Waste Franchise Area. <br />7.2.2. Collection of Solid Waste shall be provided at least once per week. <br />7.2.3. Container type, size, and frequency of service shall be sufficient so that Commercial Customers are able <br />to place all Solid Waste in the appropriate Collection Container without overflow and to prevent the creation of <br />a public nuisance or a threat to the public health, safety, or welfare. If necessary, the Contract Manager or their <br />designee shall assist Franchisee and Customer in confirming that the size of the collection container and <br />frequency of collection service are sufficient to ensure that Solid Waste is not routinely placed or stored outside <br />of the collection container. <br />7.2.4. Collection containers shall be placed at locations that are mutually acceptable to Franchisee and <br />Commercial Customer, and in compliance with County ordinance. If a dispute should arise between a <br />Commercial Customer and Franchisee regarding the location of a collection container, the Contract Manager <br />shall consult with the County's Community Development Department and designate the location. <br />7.2.5. Where several Commercial Customers are in close proximity to each other, such as in the same <br />shopping center or the same mall, such Customers may enter into a joint agreement to contract with Franchisee <br />to collect Solid Waste in shared containers. Franchisee shall be responsible for joint agreements. <br />7.2.6. Franchisee shall purchase, equip, and maintain Ultra High Frequency (UHF) Radio Frequency <br />Identification (RFID) tags on all commercial containers serviced. Technical specifications for the required RFID <br />tags are provided in Exhibit 6. <br />7.3. Commercial Recycling <br />7.3.1. Franchisee shall encourage all persons utilizing a Commercial Property to recycle and shall provide for <br />collection of Recyclables. The types of Recyclables collected from Commercial Customers shall, at a minimum, <br />include the Program Recyclables listed in Exhibit 3. <br />7.3.2. Frequency of collection for Recyclables may be provided as agreed upon by the Commercial Customer <br />and Franchisee. <br />7.3.3. The rate charged by the Franchisee for collection of commercial Recyclables shall be less than the <br />collection rate charged for servicing a Solid Waste container of equal size and frequency. <br />7.3.4. Service is not exclusive to Franchisee, and Franchisee is responsible for processing and all processing <br />costs. <br />7.3.5. Government Services <br />The Franchisee shall provide Single Stream commercial recycling collection services to various Indian <br />River County Governmental Buildings and Facilities on a weekly basis. A detailed listing of the locations <br />and summary of the size of the containers and services is provided in Exhibit 8. The Franchisee shall <br />provide a unit price for the various types of containers to be paid on a monthly basis. The franchisee <br />shall be responsible for new carts, cart replacement, and cart maintenance. Please note, some locations <br />have carts equipped with gravity locks (see Exhibit 7 for lock specifications). The franchisee will be <br />responsible for purchase and installation of future gravity locks as designated by SWDD Contract <br />Manager or designee. The Franchisee shall honor these unit rates (or any approved adjusted rates) for <br />any additional locations specified by SWDD during the term of the Agreement.
