Indian River County Solid Waste Disposal District <br />Solid Waste and Recyclables Franchise Agreement <br />20.2. Use of County Themes and Logos <br />20.2.1. Franchisee must obtain pre -approval from the Contract Manager prior to using the County logo on <br />materials or messaging of any kind. <br />20.2.2. Franchisee shall display, upon request, SWDD's recycling, waste reduction, and conservation themes <br />and logos on signs (decal or painted) and on designated vehicles used in providing Collection Services. Lettering <br />size shall be appropriate to the size of the sign. The Contract Manager shall approve the content, style, size, and <br />form. The cost of complying with this section will be considered part of Franchisee's annual education, <br />promotion, and public awareness requirement. <br />20.3. Distribution with Recycling Containers <br />20.3.1. Franchisee shall distribute informational, promotional, and educational materials (brochures, <br />newsletters, door hangers, etc.) provided by SWDD, with each new or replacement Recycling Roll Cart delivered <br />to a Customer. <br />20.4. Distribution of Information to Commercial C <br />20.4.1. Franchisee shall include in notices to all Commercial Customers information regarding the County's <br />recycling program, waste reduction, conservation programs, and Hazardous Waste Collection programs. These <br />notices shall occur in March and November of each year and Franchisee shall issue this notice under the direction <br />and to the satisfaction of the Contract Manager. <br />ARTICLE 21. FRANCHISE FEE <br />The Franchise Fee shall pertain to Residential Collection Service and Commercial Collection Service. No Franchise Fee is <br />required for Residential Recyclables Collection Service. Franchisee shall remit a Franchise Fee in the amount of six <br />percent (6%) of gross revenues collected in the immediately preceding month pursuant to the Franchise granted herein <br />to the SWDD, by check, on or before the fifteenth (15th) Day of each month. <br />Franchisee shall remit a Franchise Fee in the amount of six percent (6%) of gross revenues collected in the immediately <br />preceding month for Residential Collection Service and Commercial Collection Service minus Residential Recyclables <br />Collection Service provided within the municipal boundaries of the Town of Indian River Shores, by check, on or before <br />the fifteenth (15th) Day of each month. <br />ARTICLE 22. COMPENSATION <br />22.1. Collection Service Rates <br />22.1.1. Rates for Residential Collection Services, Residential Recyclables Collection Service, and Commercial <br />Collection Service are provided in Exhibit 1. All rates are subject to rate adjustments set forth in Article 22.2. <br />No additional fees or charges shall be billed by the Franchisee unless approved by the Contract Manager. <br />22.1.2. The Residential Collection Services rate is the total rate that may be charged by Franchisee and includes <br />all collection costs and Franchise Fees. Franchisee shall not separately state the amount of the Franchise Fee on <br />any bill to any Residential Customer. <br />22.1.3. The rates for Commercial Collection Service set forth in this Agreement include the Franchisee Fee. <br />Disposal is a pass-through charge for all roll -off services based on actual tonnage and the applicable fees at the <br />Designated Facility. <br />22.2. Rate Adjustment <br />22.2.1. Franchisee may request an annual rate adjustment. Such request must be submitted in writing to <br />SWDD no later than March 15th of the year in which the Franchisee would like the rate adjustment to go into <br />effect. The Contract Manager shall review the request and shall make a recommendation to the Board. Such <br />rate adjustments are subject to approval by SWDD Board. If approved, the rate adjustment would become <br />effective October 1 of that year. <br />0 <br />
