ANALYSIS: <br />The developer has completed the majority of the required <br />subdivision improvements for the Master Plat area (phase 1 and <br />phase 2). As provided by the LDRs, the developer desires to <br />proceed with recording the Master Plat and proposes to "bond -out" <br />for construction of the required subdivision improvements. A <br />certified engineer's cost estimate for the Master Plat area (phase <br />1 and phase 2) has been accepted by the Public Works Department. <br />The developer has also submitted a contract for construction of <br />required subdivision improvements and posted suitable security for <br />the Master Plat area (phase 1 and for phase 2). <br />The developer's contractor has posted a bond with the developer for <br />phase 1 roadway improvements within county rights-of-way (45th <br />Street and Indian River Boulevard). In order to satisfy county <br />warranty and maintenance requirements, the developer has executed <br />an agreement acceptable to the county attorney's office for an <br />assignment of rights under the maintenance bond in favor of the <br />county (attachment W. <br />With the submitted documents, the developer has complied with the <br />appropriate requirements to obtain final plat approv;al. <br />RECOMMENDATION: <br />Based upon the analysis performed, staff recommends that the Board <br />of County Commissioners grant final plat approval for the Oak <br />Harbor Master Plat and authorize the Chairman to sign the contract <br />for construction and escrow agreements for the Master Plat area <br />(phase 1 and phase 2), and to sign the assignment of rights under <br />the maintenance bond. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously (4-0, <br />Commissioner Bird absent) granted final plat <br />approval for Oak Harbor Master Plat, and authorized <br />the Chairman to sign the contract for construction <br />and escrow agreements for the Master Plat area <br />(phase 1 and phase 2) and the Assignment of Rights <br />Under the Maintenance Bond, as set out in staff's <br />recommendation. <br />SAID DOCUMENTS ARE ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />H.
