traffic in order to control speeds, etc. At the P & Z Commission <br />meeting, staff raised the issue of traffic calming and recommended <br />that before and after the signal is installed, a traffic monitoring <br />plan be put in along 53rd Avenue to find out if there are increases <br />in traffic, speed, etc. Staff recommended that the applicant <br />escrow funds for potential solutions to the problem if, in fact, a <br />problem arises. The P & Z Commission went along with that <br />recommendation and staff then met with Wal-Mart and the County's <br />Traffic Engineering staff to find out what kinds of solutions there <br />would be for traffic calming. Traffic Engineering wasn't enamored <br />or satisfied with the types of solutions proposed by Wal-Mart at <br />that meeting. Staff and Wal-Mart concluded that Traffic <br />Engineering would be responsible for the types of solutions and <br />working with the people along 53rd Avenue and that Wal-Mart would <br />be responsible for monitoring 53rd Avenue to provide data to find <br />out if there is a problem and the characteristics of that problem. <br />With that data, Traffic Engineering could devise a solution if <br />there is a problem. Director Boling reported that the P & Z <br />Commission met last week on the final site plan and.got into the <br />traffic calming issue again. Their recommendation was to have Wal- <br />Mart post $10,000 to pay for any type of traffic improvements that <br />might be needed, and that recommendation is being brought to the <br />Board this morning. <br />Director Boling responded to Chairman Adams' inquiries about <br />complaints about loading operations with the existing wall, parking <br />lot lighting, and hedges around the fenced stormwater areas. <br />Chairman Adams asked if the Sheriff's needs for law <br />enforcement had been addressed in this rezoning, and Director <br />Boling advised that there is no net increase from the amount of <br />actual retail building space that was approved last time. <br />Chairman Adams inquired about Wal -Mart's plans for building <br />the Sam's store, and Commissioner Macht asked if there is a <br />provision in our laws where a portion of property reverts to its <br />original zoning if it is not used for the commercial purpose for <br />which it was proposed. <br />Community Development Director Bob Keating explained that <br />we don't have that provision with respect to PD rezonings. <br />Attorney Vitunac advised that it would be difficult under the <br />Private Property Rights Amendment to go back to a lesser zoning -- <br />there would be an issue there. He did not believe it was a promise <br />to do something (to build Sam's) ; they have a right to do it if <br />they want. In this case they are not taking a limited resource; <br />they have the zoning for it. They can build it or not.
