BOOK 99 PAGE 295 <br />Director Keating explained Wal-Mart has pretty much <br />accomplished everything but the actual building of Sam's. When the <br />Wal-Mart and Sam's project was reviewed for concurrency, they paid <br />their traffic impact fees for the total square footage amount and <br />received a 5 -year concurrency certificate by agreeing not to <br />request getting their money back for non -commencement purposes. <br />They have made a major commitment with that. <br />Commissioner Macht recalled that they brought the project to <br />the Board based on the construction of specific dimensional <br />facilities, and they have not done that. They have not kept their <br />word on a lot of things. Why would we expect them to keep their <br />word on others? <br />Attorney Vitunac advised that the Board always has -the power <br />to look at any piece of property and rezone it if conditions <br />warrant it. <br />Discussion ensued about the signs above the 4 handicapped <br />parking spaces in front of the garden center being torn down and <br />whether they will be restored. The Board gave direction to staff <br />to see that the handicapped signs that were removed be replaced <br />with signs at the proper eye level. Director Boling advised that <br />all signage is inspected before a Certificate of Occupancy is <br />issued. <br />Attorney Vitunac asked if there was a time limit regarding the <br />$10,000 for traffic calming improvements to 53rd Avenue, and <br />Director Boling advised that staff is proposing that the money be <br />escrowed for two years to cover any improvements during a monitor <br />plan period. 53rd Avenue will be monitored for at least 2 years. <br />Wal-Mart will be responsible for the cost of the monitoring. In <br />addition, Wal-Mart has agreed to pay the entire cost of a traffic <br />signal at 53rd Avenue if the DOT deems one is necessary at that <br />location. <br />Director Keating advised that ideally staff would not like a <br />signal on SR -60 because it lowers the level of service, decreases <br />the speed, reduces the capacity, and reduces the vehicular flow. <br />Staff would prefer to have the fewest signals possible. Wal-Mart <br />wants a signal at 53rd Avenue and they have agreed to pay the <br />entire cost of the signal. Staff is saying that the signal itself <br />is a catalyst to create the cut through traffic on 53rd Avenue. <br />The traffic signal would meet the State's criteria for a distance <br />from the light at SR -60 and 58th Avenue.
