<br /> <br /> <br />PAGE 104 <br /> <br />Policy 10.5: <br /> <br />The county hereby adopts the following specific criteria pertaining to shoreline stabilization within the unincorporated <br />portion of Indian River County and within the municipal limits of the City of Vero Beach: <br /> ~ Only structures vulnerable to erosion from a 15 year or less storm event shall be permitted to construct rigid <br />shoreline stabilization structures; <br /> ~ All shoreline stabilization projects shall be approved by the Community Development Department, excluding <br />those projects eligible for an emergency permit under Chapter 161, F .S., as authorized by the Public Works Director; <br /> ~ Rigid shoreline stabilization structures shall not be permitted on vacant properties; <br /> ~ The property owner( s) shall be required to assume responsibility for and agree to mitigate any adverse <br />environmental impacts attributed to the stabilization project, including increased down-drift erosion to the adjacent <br />property, throughout the life of the stabilization project; <br /> ~ Construction activity oceanward of the County's Dune Stabilization Setback Line (D.S.S.L.) shall be avoided to <br />maximum extent possible, and prohibited during sea turtle nesting season (March 1 to October 31) unless expressly <br />approved by the Florida Department of Environmental Protection (FDEP). <br /> ~ Daily monitoring of sea turtle nesting activity shall be conducted by an individual certified by the FDEP in <br />conjunction with any construction activity oceanward of the D.S.S.L. during sea turtle nesting season. In the event a nest <br />is discovered, the FDEP Bureau of Protected Species Management and the Environmental Planning Section shall be <br />notified immediately. The individual responsible for sea turtle monitoring shall submit a nesting activity report to the <br />Environmental Planning Section and FDEP Bureau of Protected Species Management on a weekly basis. <br /> ~ All dune vegetation oceanward of the D.S.S.L. removed or damaged as a result of construction activity shall be <br />replanted with native dune vegetation material capable of obtaining a minimum height of four (4) feet above the <br />existing grade within two (2) years of planting; <br /> ~ The contractor shall be required to meet on-site with the County's Coastal Engineer or a designee assigned by the <br />Public Works Director prior to commencing construction; <br /> ~ Prior to commencing construction, the applicant shall have received a Notice to Proceed from the FDEP's Bureau <br />of Beaches and Coastal Systems; <br /> ~ Nighttime construction activity associated with shoreline stabilization projects shall be prohibited during sea <br />turtle nesting season; and, <br /> ~ Storage of construction materials on the beach/dune system during sea turtle nesting season shall be prohibited. <br />Revise <br />The County hereby adopts the following specific criteria pertaining to <br />shoreline stabilization within the unincorporated portion of Indian River <br />County and all oceanfront properties lying within the municipal limits of <br />the City of Vero Beach: <br /> ~ Rigid permanent shoreline protection structures shall be <br />permitted if: The bulkhead or seawall is necessary to protect real <br />property improvements from a twenty-five-year or less intensity storm <br />event, utilizing methods approved by the Division of Beaches as Shores <br />of the Florida Department of Natural Resources; <br /> ~ Rigid structures may be permitted if the county engineering <br />department and the Division of Beaches and Shores of the Florida <br />Department of Natural Resources recommendations include the <br />utilization of a rigid structure over other alternatives; <br /> ~ All shoreline stabilization projects shall be approved by the <br />Community Development Department, excluding those projects eligible <br />for an emergency permit under Chapter 161, F .S., as authorized by the <br />Public Works Director; <br /> ~ Rigid shoreline stabilization structures shall not be permitted on <br />vacant properties; <br /> ~ The subject property owner assumes responsibility and agrees to <br />mitigation of any adverse environmental impacts, including increased <br />downdrift erosion of adjacent property, throughout the life of the <br />stabilization project; <br /> ~ Construction activity oceanward of the County's Dune <br />Stabilization Setback Line (D.S.S.L.) shall be avoided to maximum extent <br />possible, and prohibited during sea turtle nesting season (March 1 to <br />October 31) unless expressly approved by the Florida Department of <br />Environmental Protection (FDEP). <br /> ~ The County should continue to enforce its sea turtle protection <br />ordinance in order to protect sea turtles along the County's beaches. <br />Efforts shall be made to make beachfront lighting ordinances within the <br />County uniform; <br /> ~ It is the policy of the Indian River County board of county <br />commissioners that no light illuminate any area of the beaches of <br />unincorporated Indian River County, Florida, during the period of the <br />year when sea turtles nest (March 1 to October 31). Lighting associated <br />with such construction or development must be in compliance with <br />FWC recommendations; <br />~ It is the policy of the Indian River County board of county <br />commissioners that no light illuminate any area of the beaches of <br />unincorporated Indian River County, Florida, during the period of the <br />year when sea turtles nest (March 1 to October 31). Lighting associated <br />with such construction or development must be in compliance with <br />FWC recommendations;
