_I <br />8.00K 99 pnu 426 <br />2. - That prior to site plan release, the applicant shall document <br />to the satisfaction of the county attorney's office, the <br />following: <br />a. The language of all easements necessary to serve the <br />proposed tower must be approved by the county attorney's <br />office, and subsequently recorded in the public records. <br />b. The tower shall be available for other parties and <br />interests. This availability shall be acknowledged in a <br />written agreement between the applicant and the county, <br />on a form acceptable to the county, that will run with <br />the land. <br />C. The tower shall be provided with the least obtrusive <br />lighting system allowed by the FAA, as described under <br />item 14.B.2. of this report. <br />Planning Director Boling advised that there is an additional <br />condition to the two conditions set out in staff's recommendation <br />for approval: Condition #3 -- If the tower is abandoned for 12 <br />months or more, it must be dismantled and removed from the site. <br />Chairman Adams mentioned a letter from Cox about justification <br />She believed it says nothing about why the tower is needed, just <br />why they want the tower. She noted that the County recently <br />received another request for a tower which was denied. She was <br />concerned that the County may have a virus with all the requests <br />for towers that are being received. <br />Director Boling explained the ownership and sites of the 6 <br />towers that have been approved by the County in 1996, noting that <br />this request, if approved, would be the 7th one this year. <br />Chairman Adams recalled that recently a tower located out of <br />the county had collapsed on itself and fell further out than <br />calculations had anticipated. She was concerned that something <br />similar might happen at the Life for Youth Ranch, and was no longer <br />comfortable with the number of feet in the fall radius. <br />Commissioner Eggert recalled that something was being added to <br />that tower by a crane and the crane had fallen. <br />Director Boling explained about wind load requirements and <br />advised that if the tower should fall, it would fall within a 60 - <br />ft. radius. <br />Chairman Adams opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. <br />28 <br />OCTOBER 15, 1996 <br />
