0 <br />40 <br />40 <br />the borrow site to be used for the project is permitted by Local, State, and Federal authorities, <br />as applicable. <br />I The Contractor shall abide by all notes and conditions on the Plans sand permits of the <br />County and Contractor; specifically those involving escarpment removal, prohibition of <br />f discharge of oil and debris, placement of non -suitable beach fill, etc. further described in these <br />technical requirement. If the Contractor violates any condition of nay permit and work is <br />stopped by the State of Florida or other public entity, then any additional costs incurred by <br />f the Contractor shall be paid by the Contractor and not charged to the County. <br />The Contractor shall post copies of all permits at the job site in a manner clearly visible. <br />14. Legal Restrictions and Traffic Provisions <br />The Contractor shall conform to all applicable laws, regulations or ordinances with regard to <br />labor employed, minimum wage, equipment certification, laws hours of work and its general <br />operations. The Contractor shall so conduct its operations that it shall no close any <br />thoroughfare nor interfere in any way with traffic on railway, highways or on water without <br />( the written consent of the proper authorities. The regulations the Contractor shall adhere to <br />are those established by, but not necessarily limited to, the Department of the Navy, U.S. <br />I Coast Guard, Department of the Army, Florida Department of Environmental Regulation, <br />Florida Department of Natural Resources and Indian River County. <br />15. Tranl2ort/Delivery <br />l The fill material shall be transported to the construction site by truck. No overflow or spill - <br />out of fill shall be permitted during transport to the fill site. All trucks shall be covered in <br />order to prevent spillage. Failure to modify those methods of operation which are resulting <br />in spillage during transport will result in suspension of transport operations and shall require <br />prompt repair or change of operations so as to prevent spillage as a prerequisite to resumption <br />of transport operations. <br />The Contractor is responsible for complying with all Department of Transportation, County <br />and other local regulations regarding weight limits for roads utilized for transport of the fill <br />material. The Contractor is likewise responsible for complying with all applicable traffic, <br />i safety and speed laws. Repeated failure of the Contractor to comply with applicable load and <br />L_ traffic regulations will result in suspension of transport operations until the Contractor <br />demonstrates to the satisfaction of the County that the Contractor has taken sufficient steps <br />to ensure compliance with these regulations. Any reduction in haul capacity of any truck <br />i- during the duration ofthe work, required to comply with load restrictions or for other reasons, <br />shall be reported to the Engineer prior to the next use of that truck (or trucks) for the work. <br />I <br />1-- Suspensions of work described above shall not form basis for claims by the Contractor for <br />time extensions of incurred costs. Unless it is later demonstrated that the Contractor was in <br />IL <br />compliance with the specifications or applicable regulations. <br />The Contractor shall provide and maintain barricades, warning signals and flagmen as <br />I. required by federal, state or local regulations and as directed by the Engineer. Any costs <br />associated with this requirement shall be included in the total project costs. And shall not be <br />I specifically reimbursed. Any damages to private or public property resulting from the <br />Contractor's operations shall be repaired by the Contractor at its expense. <br />TP 4 <br />
