[pg. 59 of the FLU Element] <br />Within Indian River County, there is one (1) area of critical state concern, and it is in the far northeastern <br />reaches of the county. The area encompasses the barrier island located south of the Sebastian Inlet, from <br />the Atlantic Ocean to the Indian River Lagoon. The southern boundary is the site of the McLarty Treasure <br />Museum at 13180 Highway AIA. The area was designated as a part of the Brevard Barrier Island Area <br />of Critical State Concern (ACSC) via HB 1489 and signed into law on July 1, 2023. The entirety of this <br />area is wholly located within the Sebastian Inlet State Park (`Park'), which is managed by the state of <br />Florida. There are no privately held lands within the `Park's' boundaries in the County and all land <br />within the `Park' are managed by the Sebastian Inlet Management Plan, which was adopted in November <br />of 2023 by the Office of Resilience and Coastal Protection, Florida Department of Environmental <br />Protection. Therefore, the County has not adopted a policy to manage state lands that already have a <br />Management Plan in place and are thus regulated at the state level. <br />In addition, the area of land identified as being within the County's Area of Critical State Concent is <br />further protected with other objectives sprinkled throughout the comprehensive plan. These are <br />objectives are as follows: <br />• The Future Land Use Element includes objectives that outline natural resource protection policies <br />including coastal habitats and dune systems. It also includes Conservation and Recreation land <br />use designations that provide regulatory protections for sensitive areas. The FLU Element <br />supports lagoon -compatible land use and funding support for water quality improvements. <br />• The Coastal Management Element includes policies county -wide (which would encompass the <br />ACSC) for such items as hurricane evacuation / protection plans for the manatee, sea turtle and <br />gopher tortoise / estuarine water quality / and natural disaster planning_ <br />• The Intergovernmental Coordination Element promotes collaborative planning with <br />municipalities, special districts, the state of Florida, and the federal government to align <br />infrastructure and land use planning_ <br />• The Stormwater Sub -Element emphasizes BMPs, stonmwater system retrofits and coordination <br />with SJRWMD for lagoon protection protects. <br />• The Sanitary Sewer Sub -Element focuses on reducing septic system reliance and improving <br />wastewater treatment to limit nutrient loading to the lagoon. <br />• Figure 4.3 of the Transportation Element identifies critical evacuation routes serving the barrier <br />island <br />C:\Users\ufc-prod\AppData\Local\Temp\BCL Technologies\easyPDF 8\@BCL@6414E534\@BCL@6414E534.docx <br />11 <br />
