Collins II - Deputy County Attorney <br />DATE: March 5, 1997 <br />SUBJECT: Lease Agreement With Gifford Junior Chamber of Commerce <br />The Board of County Commissioners on March 4, 1997 terminated the Lease <br />Agreement with the Indian River Ministerial Council for the property known as <br />the Old Gifford Jaycee Building located at 4716 33`d Avenue. Termination was <br />for failure to comply with the covenant of paragraph 7 to renovate the building <br />within six months. <br />The Board also directed staff to bring back a Lease Agreement with the Gifford <br />Junior Chamber of Commerce which is attached. The following revisions to the <br />prior lease were made: <br />1. The dates were revised for a leasehold period from 1997 through 2002, <br />i.e., five years. <br />2. Paragraph 7 dealing with renovation is revised to require that the <br />specifications for renovation be prepared by a licensed architect and that <br />the renovation be under the supervision of licensed contractors and <br />subcontractors. (None of the individuals listed to oversee construction on <br />the Gifford Junior Chamber of Commerce "manpower assignments" are <br />licensed contractors.) <br />3. Paragraph 8 of the agreement is revised to specify what insurance <br />coverage is satisfactory to the County. Although the Board requested that <br />the Jaycees show insurance at the time of signing, until the lease is <br />executed, I don't believe they have an insurable interest. This should not <br />be a concern because under the terms of paragraph 8 the Jaycees must <br />supply written proof of insurance within fifteen days, and failure to do so <br />automatically terminates the lease. <br />4. Paragraph 10 is added to ensure the facility is used as a "community <br />center", an allowable RM -10 zoning district use. <br />RECOMMENDATION: <br />1. The Board find that the use of the leased premises constitutes a <br />"community center as defined in County land development regulations. <br />2. The Board authorize the Chairman to execute the lease on behalf of the <br />Commission. <br />Mr. Kevin champion, president of the Gifford Junior Chamber of <br />Commerce (GJCC), agreed with the terms of the lease. <br />45 <br />PAGE Sjq <br />March 11, 1997 <br />
