Chairman Eggert suggested that a draft resolution be brought <br />back to the Board for consideration. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Ginn, the Board unanimously agreed that <br />a draft resolution creating a Utilities Advisory <br />Committee be brought back for consideration. <br />REPORT ON NACo CONFERENCE <br />Commissioner Macht advised that he had attended the annual <br />NACo Legislative Conference held last week in Washington, D.C. He <br />explained the purpose of NACo with respect to legislation and <br />defined "flow control" as the ability of county governments to <br />designate where trash is taken and processed. <br />Commissioner Macht then explained the establishment of the <br />Landfill and that it is required under the bond issue that everyone <br />in the county must dump in that Landfill. He advised that the <br />Supreme Court, under the constitutional provision of giving the <br />Congress exclusive right to control interstate commerce, struck it <br />down as being unconstitutional. The Supreme Court has designated <br />garbage as being a matter of commerce, because it has value. So we <br />cannot require people to dump their refuse in our Landfill, nor can <br />we forbid it. Congress will not speak to the interstate aspect of <br />this, but they will consider a very limited "flow control bill" <br />with a grandfather aspect. He could not predict whether that <br />proposed legislation would pass, but he reported the comments of <br />several legislators about it. He indicated it would certainly <br />affect a recycling park with respect to what can and cannot go into <br />it. <br />Commissioner Adams commented that it affects the current <br />financial stability of our Landfill. <br />County Attorney Vitunac remarked that luckily our Landfill <br />pays its way by assessment, not tipping fee, so we are not actually <br />impacted by that aspect of it. <br />Commissioners voiced their various concerns and opinions and <br />discussed what nearby communities had been doing in recycling. <br />Utility Services Director Terry Pinto explained that we cannot <br />prohibit garbage from going outside our district, however we can <br />prohibit material from coming into our county -owned landfill. If <br />a private landfill were built, we could not prohibit them from <br />bringing in garbage from outside the county.
