Hammond's request to amend the comprehensive <br />plan to redesignate approximately 15.2 acres from L-1 to <br />M-1, and to rezone approximately 30.3 acres from A-1 to <br />RM8-8 <br />PLAN AMENDMENT NQMBER: LDDA 96-07-0232 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County.Commissioners at their regular <br />meeting of March 18, 1997. <br />DESCRIPTION AND CONDITIONS <br />This request involves both a land use designation amendment and a <br />rezoning. The land use designation amendment involves <br />redesignating approximately 15.2 acres from L-1, Low -Density. <br />Residential -1 (up to 3 units/acre) to M-1, Medium -Density <br />Residential -1 (up to 8 units/acre). The rezoning request involves <br />changing 130.3 acres, consisting of the 115.2 acres to be <br />redesignated and the adjacent 115.1 acres to the east, from A-1, <br />Agricultural District (up to 1 unit/5 acres) to RMH-8, Mobile Home <br />Residential District (up to 8 units/acre). The subject property is <br />located on the north side of 26th Street, approximately a quarter <br />mile east of 74th Avenue. The purpose of this request is to secure <br />the land use designation and zoning necessary to develop the site <br />as a mobile home park. <br />On September 26, 1996, the Planning and Zoning Commission voted 5-1 <br />to recommend that the Board of County Commissioners transmit the <br />proposed land use amendment to the State Department of Community <br />Affairs (DCA) for their review. <br />On November 21, 1996, the Board of County Commissioners voted 4-1 <br />to transmit the proposed land use amendment request to DCA for <br />their review. <br />At both the Planning and Zoning Commission public hearing and the <br />transmittal public hearing, Robert Adair of the Kerr Center for <br />Sustainable Agriculture raised concerns regarding a mobile home <br />park's compatibility with the existing agricultural uses to the <br />north of the subject property. At both of those meetings, Mr. <br />Adair asked that the subject request be denied. Mr. Adair also <br />stated, however, that if the subject request was not denied, then <br />requiring a large building setback on the subject property would be <br />an acceptable alternative. At both public hearings, staff pointed <br />out that special development conditions could not be imposed on a <br />land use designation amendment and/or rezoning approval. <br />After Mr. Adair spoke at the transmittal hearing, the Board of <br />County Commissioners discussed redesignating only the south 1,200 <br />feet of the *1,320 foot site to M-1. The purpose of that <br />alternative would be to ensure that a 120 foot mobile home park <br />building separation distance would be established from the existing <br />agricultural uses to the north of the subject property. <br />The proposed amendment, along with an addendum, was transmitted to <br />DCA on November 21, 1996. The addendum explained that the Board <br />approved transmittal of an amendment redesignating only the <br />southern 1,200 feet of the subject property. The addendum, <br />however, requested that DCA review the request for the egtire site, <br />but to be aware that a portion of the site may be removed from the <br />request at the time of adoption.
