e��4 <br />BOCK �.0. fAG� <br />The Board recently invoked the pending ordinance doctrine to <br />establish a 120' setback between residential projects and <br />active agricultural applications. Within the next 6 weeks, <br />the Board will have the opportunity to consider an LDR <br />amendment on the buffer issue. The pending ordinance doctrine <br />invoked by the Board does not apply to this application, since <br />it was received and reviewed prior to the Board's action. <br />Therefore, this application has been reviewed under the <br />current LDR buffer requirements. <br />16. Caribbean Fruit Fly Host Plant: While the county does not <br />address this issue in its LDRs, there has been a county policy <br />of discouraging the planting of host plants in agricultural <br />areas. The applicants have indicated that they would have no <br />objection to creating a restriction that would prohibit host <br />plants on the subject property. Staff will continue to <br />recommend inclusion of such a restriction when the project <br />covenants and restrictions are reviewed at the time of final <br />plat application. <br />In considering the subject PD special exception use request, <br />the Planning and Zoning Commission voted unanimously to add a <br />condition that would require the creation of covenants and <br />restrictions applicable to the subject property that would <br />prohibit host plants that harbor infestations harmful to <br />citrus. <br />17. That prior to the issuance of a land development permit or <br />permit waiver, the applicant shall obtain a Type "B" <br />stormwater management permit from the Public Works Department. <br />2. That prior to or at the time of final plat recording, the <br />applicant shall create covenants and restrictions that would <br />prohibit the use -of host plants on the subject property that <br />harbor infestations harmful to citrus. <br />22 <br />April 22, 1997 <br />M <br />M <br />
