Chairman Eggert wondered how close the nests are to where the work is being
done, and Coastal Engineer Jeff Tabar stated that the activity has increased during the last
2 weeks but there have not been any nests noted within the project area.
Attorney Chester Clem, representing Dirk and Brenda Parvus, emphasized that his
clients are under a severe hardship. They have paid Mr. Cangianelli a considerable
amount of money and are requesting that the contractor be allowed to finish the work from
the beach. After June 1'd the work can be continued from the landward side. His clients are
willing to contribute $4,500 and the other property owners are holding $5,500 which they
are authorized to put up. Also, they are being monitored by Tri -Tech for turtle nesting
activity.
Commissioner Adams stressed that Mr. Clem could guarantee the money but not
the contractor's performance and expressed her concern about the contractor's credibility.
Robert Bamey of 1550 Penlynn Street, Sebastian, questioned why the contractor
had been allowed to use the Park free of charge and suggested charging beach sand
rather than monies so the responsibility does not fall back on everyone else.
MOTION WAS MADE by Commissioner Ginn,
SECONDED by Commissioner Macht that the Board
grant an extension to June 1, 1997, with the restrictions
that the County will hold the $10,000 to guarantee the
restoration of Wabasso Park; that Fish & Wildlife grant
their permission; and that the turtle nesting be
constantly monitored.
Commissioner Adams requested that the Motion be amended to add that the
contractor not be in the Park over the observed Memorial Day weekend; that materials not
be stored at the Park longer than 24 hours; and that if the contractor does not cooperate,
the County shall have the right to immediately remove him.
COMMISSIONER GINN AMENDED HER MOTION TO
INCLUDE THOSE RESTRICTIONS SUGGESTED BY
COMMISSIONER ADAMS, AS WELL AS TO INCLUDE
THE HOMEOWNERS' POSTING OF THE $10,000,
SECONDED BY COMMISSIONER MRCHT.
THE CHAIRMAN called the question and the amended
Motion passed by a 4-1 vote (Commissioner Adams
opposed).
MAY 69 1997 77
MR r,act
