Chairman Eggert wondered how close the nests are to where the work is being <br />done, and Coastal Engineer Jeff Tabar stated that the activity has increased during the last <br />2 weeks but there have not been any nests noted within the project area. <br />Attorney Chester Clem, representing Dirk and Brenda Parvus, emphasized that his <br />clients are under a severe hardship. They have paid Mr. Cangianelli a considerable <br />amount of money and are requesting that the contractor be allowed to finish the work from <br />the beach. After June 1'd the work can be continued from the landward side. His clients are <br />willing to contribute $4,500 and the other property owners are holding $5,500 which they <br />are authorized to put up. Also, they are being monitored by Tri -Tech for turtle nesting <br />activity. <br />Commissioner Adams stressed that Mr. Clem could guarantee the money but not <br />the contractor's performance and expressed her concern about the contractor's credibility. <br />Robert Bamey of 1550 Penlynn Street, Sebastian, questioned why the contractor <br />had been allowed to use the Park free of charge and suggested charging beach sand <br />rather than monies so the responsibility does not fall back on everyone else. <br />MOTION WAS MADE by Commissioner Ginn, <br />SECONDED by Commissioner Macht that the Board <br />grant an extension to June 1, 1997, with the restrictions <br />that the County will hold the $10,000 to guarantee the <br />restoration of Wabasso Park; that Fish & Wildlife grant <br />their permission; and that the turtle nesting be <br />constantly monitored. <br />Commissioner Adams requested that the Motion be amended to add that the <br />contractor not be in the Park over the observed Memorial Day weekend; that materials not <br />be stored at the Park longer than 24 hours; and that if the contractor does not cooperate, <br />the County shall have the right to immediately remove him. <br />COMMISSIONER GINN AMENDED HER MOTION TO <br />INCLUDE THOSE RESTRICTIONS SUGGESTED BY <br />COMMISSIONER ADAMS, AS WELL AS TO INCLUDE <br />THE HOMEOWNERS' POSTING OF THE $10,000, <br />SECONDED BY COMMISSIONER MRCHT. <br />THE CHAIRMAN called the question and the amended <br />Motion passed by a 4-1 vote (Commissioner Adams <br />opposed). <br />MAY 69 1997 77 <br />MR r,act <br />
