The agriculture/residential buffer issue is a priority item for the <br />Board and has been expedited for review through the Agriculture <br />Advisory Committee, Professional Services Advisory Committee, and <br />the Planning and Zoning Commission. Additionally, the LDR <br />amendments proposed in relation to the agriculture/residential <br />buffer issue would require Board consideration at only one hearing <br />that could be held as part of a normal Board meeting. Therefore, <br />in staff's opinion, the Board should consider the <br />agriculture/residential buffer LDR amendments separately, at the <br />soonest available regular meeting. A meeting date which would <br />satisfy advertising requirements for Board action on the <br />agriculture/residential buffer issues is the May 20, 19-97 regular <br />Board meeting. <br />The other LDR amendments include issues that either require PSAC <br />and Planning and Zoning Commission review or will require two <br />public hearings. In staff's opinion, hearings for these amendments <br />could be handled during regular Board meetings in June. If the <br />Board, by a majority of 4 or more votes, decides to hold the <br />hearings before 5:00 p.m., then hearings could be held during the <br />June 10th and June 24th regular Board meetings. Since the proposal <br />to allow banks within the PRO district requires 2 hearings, a final <br />decision on that proposal would be rendered at the June 24th <br />hearing. All other amendments could be finalized at the June 10th <br />hearing. <br />The Board may establish any other dates that meet state <br />requirements. However, in regard to the PRO district proposal, the <br />Board must approve dates for 2 public hearings that are at least 10 <br />days apart and that accommodate advertising deadlines. <br />Staff recommends that the Board of County Commissioners: <br />1. Approve holding the public hearings before 5:00 p.m. -(requires <br />at least 4 positive votes). <br />2. Set a May 20, 1997 hearing date to consider LDR amendments <br />related to agriculture/residential buffers. <br />3. Set June 10, 1997 and June 24, 1997 hearing dates for the <br />remaining LDR amendments. <br />Commissioner Tippin left the meeting on private business. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Ginn, the Board, by a 4-0 vote <br />(Commissioner Tippin being absent) approved holding the <br />public hearings before 5:00 p.m.; set May 20, 1997 as the <br />hearing date to consider LDR amendments related to <br />agriculture/residential buffers; and set June 10, 1977 and <br />June 24, 1997 as hearing dates for the remaining LDR <br />amendments, as recommended by staff. <br />MAY 6, 1997 79 BL";1y 1_01 m -M? <br />
